The petitioner is apprehending his arrest in connection with Shikaripara P.S. Case No.57 of 2024, for offence registered under section 414/34 of the IPC and section 11(1)(iv)(v) of Prevention of Cruelty of Animals Act and section 12 (2) of Jharkhand Bovine Animal (Prohibition of Slaughter) Act, 2005, pending in court of learned A.C.J.M., Dumka.

Learned counsel for the petitioner submits that the petitioner happened to be the owner of pick up van and the allegations are made that in the pick up van 17 calves were being transported. She also submits that the said calves were purchased by receipt no.1666, 1667 and 1668 and that has come in the order of the learned Sessions Judge. She next submits that the petitioner

is having no criminal antecedent as disclosed in paragraph no.13 of the petition.
4. Learned State counsel opposes prayer and submits that in cruel manner the calves were being carried in the said pick up van.

Considering that the petitioner happened to be the owner of the pick up van and he is not having any criminal antecedent as disclosed in paragraph no.13 of the petition, and in that view of the matter, the petitioner, above named, is directed to surrender before learned court within two weeks from today and learned court shall release petitioner, above named, on such terms and conditions as well as sureties as learned court may deem fit and proper.
6. This petition being A.B.A. No.1016 of 2026 is disposed of.
