JUSTICE BIPIN GUPTA Judgment / Order 16/01/2026 1. The present writ petition has been filed assailing the order dated 07.10.2025, whereby, on an application of the judgment- debtor, the Court has ordered a site inspection for the purpose of finding out that whether the auction purchaser is in excess of the possession of which the auction has been made to him. 2. This Court finds no error apparent on the face of the record so as to call for any interference under Article 227 of the Constitution of India. 3. Hence, the civil writ petition is dismissed. 4. It is further contended by learned counsel for the petitioner that the property which has been auctioned to him is not free from [2026:RJ-JP:1895] (2 of 2) [CW-28/2026] encumbrances, and in this regard, his application is pending for appropriate orders. 5. It is expected that if any such application is pending, the learned trial Court shall decide the same as expeditiously as possible. 6. Pending application(s), if any, shall also disposed of.
