Anil Kumar Godha, R/o 125, Mangal Vihar, Gopalpura Bypass, Jaipur. ----Respondents For Appellant(s) : Mr. Saket Pareek For Respondent(s) : Mr. Mahendra Shah, Sr. Adv. assisted by Mr. Kamlaesh Sharma Mr. Nakul Bansal and Mr. Shreyansh Dharival HON'BLE THE ACTING CHIEF JUSTICE MR. SANJEEV PRAKASH SHARMA HON'BLE MRS. JUSTICE SANGEETA SHARMA Order 21/01/2026 We notice that the challenge is to the order dated 14.10.2025 passed by the learned Single Judge wherein, the Court issued notice to respondent Nos.1 to 4, while the counsel appears for respondent No.5. [2026:RJ-JP:2683-DB] (2 of 2) [SAW-1465/2025] The appeal before us is by respondent No.5- Vikas Sharma assailing the order whereby, the learned Single Judge has directed the respondents not to demolish the premises of the petitioner till the next date of hearing. Thus, it is apparent that the Court has not examined the matter on merits in detail and has awaited the reply to be filed by the respondents. However, this present appeal is filed by respondent No.5. Learned counsel submits that the order passed by the learned Single Judge would amount to actually deciding the matter. We do not agree, the case has to be examined on merits and if the property-in-question would be demolished, the irreparable loss would be caused to the writ petitioner. We, therefore, do not find any reason to interfere with the interim order dated 14.10.2025. The appeal is dismissed. It is always open for the appellant to move an appropriate application for making request for early listing of the case and also for early disposal. All pending application(s) stand disposed of.
