Heard the parties. 2. Learned counsel appearing on behalf of respondents submits that the possession of the property has been given to the respondent No.3 by evicting the petitioner. 3. As per the learned counsel for the petitioner, the JBC Appeal is still pending before the Appellate Authority. 4. Considering the fact that the appeal is pending before the Appellate Authority, it is expected that the appeal should be decided as expeditiously as possible on merits, as the same cannot be said to have become infructuous by evicting the petitioner, since the issue of arrears of rent is also to be considered by the authority. 5. Further, if the order in respect of arrear of rent has attained finality, liberty is reserved with the landlord to execute the order. 6.
