1.
This MCC has been filed seeking modification in the order dated 21.04.2026, passed in MAC-876-2020 (Smt. Sangita Bai and others v. Tularam @ Bhola and others), whereby due to inadvertence and typographical error in Para-06 it has wrongly been mentioned as “It is made clear that 50% of the enhanced amount of compensation shall be borne by respondent No.03/Insurance Company and the remaining 50% amount shall be borne by respondent No.06/Insurance Company”, whereas it ought to have been “50% of the enhanced amount of compensation shall be borne by the respondent No.03/Insurance Company and the remaining 50% amount shall be borne by the respondents No.01 & 02 therein i.e. owner and driver of the offending vehicle”. Thus, modification to that extend is prayed for. 2. After hearing learned counsel for the parties and going through the record, since it appears to be a typographical error, Para-06 of order dated 21.04.2026, passed in MAC-876-2020, is modified to the extent and the words- “It is made clear that 50% of the enhanced amount of compensation shall be borne by respondent No.03/Insurance Company and the remaining 50% amount shall be borne by
3 respondent No.06/Insurance Company”, are replaced with the words-
“It is made clear that 50% of the enhanced amount of compensation shall be borne by the respondent- Tata AIG General India Insurance Co. Ltd. and the remaining 50% amount shall be borne by the respondents- Tularam Bhola and Banshilal i.e. owner and driver of the offending vehicle jointly”. 3. With aforesaid mortification in the order dt. 21.04.2026, passed in MAC-876-2020, the present MCC is allowed. No cost. sd/- s@if (Sanjay K. Agrawal)
