Respondent No. 1, who is present in person, prays that a legal aid counsel be appointed to defend her case, as she is unable to bear the expenses of hiring the services of Advocate. Request considered and allowed.
2. Consequently, Ms. Preeti Thakur, Advocate, who is present in Court, is appointed as Legal Aid Counsel to defend the case of respondent No. 1. The Secretary, H.P. State Legal Service Authority, Shimla is directed to do the needful.

3. After arguing for some time, learned counsel for the appellants submits that he wants to withdraw the present appeal, with a liberty to file claim petition, under Section 163-A of the Motor Vehicles Act. Request considered and allowed.
