JUSTICE R DEVDAS ORAL ORDER In terms of the directions issued by this Court on 10.02.2026, the learned High Court Government Pleader has filed the Affidavit of the Tasildar, Bengaluru East Taluk, where it is stated that Sy. No.290 of Gunjuru Village (Hosahalli Grama), Varthur Hobli, Bengaluru East - 3 - HC-KAR NC: 2026:KHC:9687 WP No. 1007 of 2026 Taluk, consisting of 1 acre 07 guntas is shown as A-kharab in the RTC. However, as per the survey records and the Tippani/Survey Sketch, the said lands fall within the ‘B’ Karab portion. However on further query, the learned HCGP submits that an extent of 21 guntas has been allotted to the Police Department for establishment of Varthur Police Station by order dated 29.01.2026. 2. If that is the admitted position, the application filed by the petitioner for regularisation of dwelling house under Section 94C of the Karnataka Land Revenue Act, cannot be rejected. 3. Consequently, the writ petition is allowed, while setting aside the impugned endorsement that Annexure ‘A’ dated on 29.12.2005 issued by the Tahsildar, Bengaluru East Taluk. The writ petition stands disposed of with a specific direction to the respondent no.4-Tahsildar, to pass necessary orders on reconsideration of the application filed by the petitioner, having regard to the fact that the petitioner’s forefathers had put up the construction - 4 - HC-KAR NC: 2026:KHC:9687 WP No. 1007 of 2026 decades ago and e-khata has been registered in the name of the petitioner in the office of the BBMP.
