02/20.07.2026 Heard learned counsel for the petitioners and learned counsel for the State.
2. The petitioners are apprehending their arrest in connection with Giridih (M) P.S. Case No. 397 of 2025, registered for the offence under Sections 191(2), 191(3), 190, 126(2), 115(2) and 109 of Bhartiya Nyaya Sanhita, 2023, pending in the court of learned Sub Divisional Judicial Magistrate, Giridih.

Learned counsel appearing for the petitioners submits that the altercation took place between the son of the informant and the co- accused persons on a trivial issue that too on enquiring the time. He next submits that good sense has prevailed between the parties and now both the sides have compromised the matter and the compromise petition has been annexed as Annexure-2 in the petition.

Learned counsel appearing for the State opposes the prayer and submits that the allegations are there of assault.

Learned counsel appearing for the informant accepts the submission of learned counsel appearing for the petitioners and submits that the compromise has taken place.

Considering that Annexure-2 is the document which suggests that compromise has taken place between the parties and the altercation took place for a trivial issue between the son of the informant and the accused persons, in the attending facts and circumstances, I am inclined to grant anticipatory bail to the petitioners.

Accordingly, the above-named petitioners are directed to surrender before the learned court within two weeks from today and in the event of their arrest or surrender, they shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Giridih, in connection with Giridih (M) P.S. Case No. 397 of 2025, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
