JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused No.4 in Crime No.151/2026 registered by Byadarahalli Police Station, Bengaluru, for the offence punishable under Sections 118(1), 115(2), 324(4), 351(2), 352, 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for short, 'BNS', 2023), is before this Court in this Criminal Petition filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking anticipatory bail. 2. Heard the learned Counsel for the petitioner and learned High Court Government Pleader appearing on behalf of the respondent - State. 3. FIR in Crime No.151/2026 was registered by Byadarahalli Police Station, Bengaluru, for the aforesaid offences against Smt.Rathnamma and her relatives, on the basis of the first information dated 31.03.2026 received from Santhosh S/o Late Lokesh, who is victim in the - 3 - HC-KAR NC: 2026:KHC:27833 CRL.P No. 7096 of 2026 present case. Apprehending arrest, the petitioner herein, who is the son-in-law of accused No.1-Rathnamma and others had filed Crl.Misc.No.671/2026 before the Jurisdictional Sessions Court and the same was rejected as against the petitioner herein is concerned on 05.05.2026. Therefore, the petitioner is before this Court. 4. Learned Counsel for the petitioner having reiterated the grounds urged in the petition, prays to allow the petition. 5. Per contra, learned HCGP has opposed the bail petition and prays to dismiss the petition. 6. Perusal of the material on record would go to show that that family of accused No.1-Rathnamma and family of the first informant, are staying in adjacent houses. It appears that there is a long standing dispute between the parties with regard to parking area. It is in this background, on 30.03.2026 at about 7.30 p.m., family members of both the parties have fought against each other and the incident in question had taken place - 4 - HC-KAR NC: 2026:KHC:27833 CRL.P No. 7096 of 2026 thereafter. The first informant-Santhosh had suffered injuries and he was admitted in the hospital. 7. Further, the material would also go to show that in respect of the alleged incident that had taken place on 30.03.2026, there is a case and counter-case and an FIR in Crime No.150/2026 was registered by Byadarahalli Police against the complainant-Santhosh and his wife- Smt.Shubha, who are the injured victims in the present case. Wife of the petitioner herein is the first informant in Crime No.150/2026 and it appears that she had suffered simple injuries in the said incident. Subsequently, the present case has been registered by the police based on the first information received from Sri.Santhosh, who is arraigned as accused No.1 in Crime No.150/2026. The petitioner, who is the son-in-law of accused No.1 allegedly has gone to the house of his in-law's for celebrating his wife's birthday. In the first information his name is not mentioned, therefore it appears that he was a stranger to Santhosh and his family members. - 5 - HC-KAR NC: 2026:KHC:27833 CRL.P No. 7096 of 2026 8. The incident in question had taken place after members of the two family had fought against each other in the background of dispute with regard to parking area. The petitioner has no other criminal antecedents and he being a stranger had no motive to cause injuries to the victims in the present case. The other accused in the present case have been granted anticipatory bail by the jurisdictional Sessions Court. The petitioner allegedly had assaulted the injured with a Wicket and in this regard, the learned High Court Government Pleader has submitted that the said weapon used for assaulting the injured has already been recovered by the police in the present case. Under the circumstances, I am of the opinion that the prayer made by the petitioner for grant of anticipatory bail is required to be answered affirmatively. Accordingly, the following: ORDER The Criminal Petition is allowed. - 6 - HC-KAR NC: 2026:KHC:27833 CRL.P No. 7096 of 2026 The Respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.151/2026 registered by Byadarahalli Police Station, Bengaluru, for the offence punishable under Sections 118(1), 115(2), 324(4), 351(2), 352, 3(5) of the BNS, 2023, subject to the following conditions: 1. The Petitioner shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- (one lakh only) with two sureties for the likesum to the satisfaction of the Investigating Officer. 2. Petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3. Petitioner shall not tamper with the prosecution witnesses and he shall co-operate - 7 - HC-KAR NC: 2026:KHC:27833 CRL.P No. 7096 of 2026 with the police for investigation and appear before them whenever called upon. 4.
