The present application is filed seeking regular bail in Crime No.262/2025 for the offences punishable under Sections 108, 80, 85, 115(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023, registered with Police Station Mahagaon, District Yavatmal. 3. The crime is registered on the basis of the report lodged by the father of the deceased alleging that the marriage of his daughter was solemnized with Vinod Tukaram Aadhav on 15/04/2020. However, after the marriage, she was not treated well. As the marriage was performed during the Covid pandemic period, no gift items were provided to her. The report further alleges that she committed suicide due to the alleged ill-treatment and harassment at the hands of the present applicant and the other co- accused. 4. The learned counsel for the applicant invited my attention to the order of this Court dated 09/12/2025 in Criminal Application [B.A.] No. 1157/2025, wherein the Court has shown its disinclination to grant bail, however, liberty was granted to file afresh, if the trial is not commenced within six months. 5. The learned counsel for the applicant submits that the trial has not commenced and even the charges are not framed. The applicant is behind bars since 19/05/2025. He further submits that his father has already been released on bail by this Court on identical allegation. The marriage between the deceased and the applicant was of the year 2020. The allegations are that due to consistent harassment, the deceased committed suicide at the matrimonial home by hanging herself. Considering the allegations, the applicant deserves to be granted bail, since no ingredients of Section 108 of the BNS are made out. He further submits that, so far as the rest of the offences are concerned, the maximum punishment Piyush Mahajan
3 42-Cr.BA-990-2026 provided is of 7 years and only under Section 108, 10 years is provided. Therefore, he prayed to grant bail. 6. On the other hand, the learned A.P.P. vehemently opposes the application and submits that this Court has already considered the matter on merits and has not released the applicant on bail. There are serious allegations of demand and dowry, and not only that, the allegations are of illicit relations of the applicant with another lady.
Under such circumstances, no option was left with the deceased but to commit suicide. Though the charges are not framed, this Court has already dealt with the matter on merits and shown its disinclination. Under such circumstances, the second application would not be maintainable, and the applicant is not entitled for bail when there is no change in circumstances. 7. I have considered the rival submissions. I have gone through the papers of investigation and also perused the order passed by this Court dated 09/12/2025. It appears that though this Court has shown its disinclination to grant bail, however, the applicant was granted liberty to file afresh, if the trial is not commenced within six months. Now, 8 months are over, however, till today, it appears that, even the charges are not framed, as was contended by the
learned counsel for the applicant. It is further to be Piyush Mahajan
4 42-Cr.BA-990-2026 noted that the applicant is behind bars since 19/05/2025, and more than one year and three months are over. Considering the nature of allegations, and the fact that this Court has already granted liberty to the applicant to approach this Court after six months, in case the trial is not commenced, I am of the considered opinion that no purpose would be served by keeping the applicant behind bars. Therefore, I am inclined to grant bail by imposing stringent conditions. Hence, the following
order:
O R D E R (i) The Criminal Application is allowed; (ii) The applicant/accused (Vinod Tukaram Aadhav) be released on regular bail in connection with Crime No.262/2025 for the offences punishable under Sections 108, 80, 85, 115(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023, registered with Police Station Mahagaon, District Yavatmal, on his furnishing a P.R. bond of Rs.50,000/- (Rupees Fifty Thousand) with two solvent sureties in the like amount; (iii) The accused shall not directly or indirectly make any inducement, threat or Piyush Mahajan
5 42-Cr.BA-990-2026 promise to any person acquainted with the facts of the case, as also shall not tamper with the evidence; (iv) The accused shall provide his residential address and cell number to the Police Station concerned and shall not change his place of residence without prior intimation to the Investigating Agency; (v) Once the trial commences, the accused shall attend each and every date of trial regularly. If he fails to attend the trial subject to genuine reason to the satisfaction of trial court, or fails to comply with the aforesaid conditions, his default would entail the State to ask for cancellation of bail; (vi) The observations of this Court are prima facie in nature. The Trial Court shall not be influenced by the same; (vii) Pending Misc. Application(s), if any, also stand disposed of [ M.M.
