----
04/Dated: 18th July, 2026
1. Heard learned counsel for the applicant and learned counsel for the State. 2. The applicant who is in custody since 06.09.2025 has renewed his prayer for grant of regular bail in connection with N.D.P.S. Case No.28 of 2026 arising out of Chatra Sadar P.S. Case No.292 of 2025, for the offence punishable under Sections 17(c), 21(c), 22(c), 28 & 29 of the NDPS Act, pending in the court of learned Additional Session Judge-III, Chatra. 3. It has been submitted by the learned counsel for the applicant(s) that complete set of FIR along with its enclosure have been annexed with this bail application and there is no suppression on his/her part. 4. Earlier the prayer for bail of the applicant was rejected on merit and considering the mandate of Section 37 of the NDPS Act by this Court vide order dated 17th February, 2026 in B.A. No.10836 of 2025. 5. It appears that all the other co-accused namely Anuj Dangi @ Abhishek Kumar Verma in B.A. No.10886 of 2025 vide order dated 16.12.2025, Jitendra Kumar Sahu in B.A. No.11159 of 2025 vide order dated 12.01.2026 and Bahadur Dangi in B.A. No.10858 of 2025 vide order dated 17.03.2026 have been granted bail. The Mandate of Section 37 of the NDPS Act is not applicable in the State of Jharkhand. Merely applying by one of the Co-ordinate Bench creating serious trouble and resulting in discrepancy in the order. All the other co-accused have been granted bail without considering the mandate of Section 37 of the NDPS Act and that has been accepted in the State of Jharkhand without giving any objection

and still keeping this applicant under custody by applying the mandate of Section 37 of the NDPS Act will be nothing but the perversity of the justice. 6.
Considering the practice of the Jharkhand High Court and especially the attitude of the State not making any objection and having no concern so far as Section 37 of the NDPS Act is concerned, I am inclined to enlarge the applicant on bail. Accordingly, the applicant, named above, is directed to be released on bail, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the learned Additional Session Judge-III, Chatra in connection with N.D.P.S. Case No.28 of 2026 arising out of Chatra Sadar P.S. Case No.292 of 2025, subject to condition that the applicant(s) will submit self-attested photocopy/photocopies of his/her/their Aadhaar Card(s) and also submit his/her/their mobile number(s) before the trial court which he/she/they will always keep active and will not change it during pendency of this case without prior permission of the court.
