Mattegunta.Sudhir,Standing Counsel For Z.P.Ps,M.P.Ps,Gram Panchayats The Court made the following: ORDER: The Writ Petition has been filed for the following relief: “…to issue a Writ of Mandamus or any other appropriate writ, order or direction, declaring the action of the Respondents more particularly the respondents 3 to 5 herein in obstructing the petitioner from constructing a Kirana Shop (Provision Shop) in Sy.No.172 to an extent of 04.69 Ankanams situated at Koppaladoruvu Village, Valluru Revenue Village, Tallapudi Grama Panchayath, Muthukur Mandal, SPSR Nellore District under due influence of the respondents 6 to 10 herein as illegal, arbitrary, and violative of principles of natural justice as well as oppose to Article 300-A of the Constitution of India consequentially direct the respondents more particularly the respondents 3 to 5 herein not to interfere with the construction activity of the petitioner in constructing a Kirana Shop (Provision Shop) in Sy.No.172 to an extent of 04.69 Ankanams situated at Koppaladoruvu Village, Valluru Revenue Village, Tallapudi Grama Panchayath, Muthukur Mandal, SPSR Nellore District…” 2. Heard the learned counsel for Petitioner and learned Assistant Government Pleader. 3. Mr. V. Sai Kumar, learned counsel for the Petitioner, submits that Respondent Nos. 3 to 5 are obstructing the Petitioner from constructing a Kirana (Provision) Shop in Sy. No. 172, to an extent of 04.69 Ankanams, situated at Koppaladoruvu Village, Valluru Revenue Village, Tallapudi Grama Panchayat, Muthukur Mandal, SPSR Nellore District, at the behest of Respondent Nos. 6 to 10. 4. Sri P. Ajay Babu, learned Assistant Government Pleader, on written instructions, submits that Respondent Nos. 3 to 5 have never interfered with 4 the Petitioner’s construction of the Kirana (Provision) Shop and that no obstruction was caused to the Petitioner at the behest of Respondent Nos. 6 to 10. 5. Having regard to the facts and circumstances of the case, and upon recording the submissions of the learned Assistant Government Pleader, the Writ Petition is disposed of directing the Respondent Police not to interfere henceforth in the civil dispute between the Petitioner and Respondent Nos.6 to 10, without following the due process of law. 6. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. As a sequel, Miscellaneous petitions, if any pending, shall stand closed. _________________________ DR. Y.
