The petitioners are apprehending their arrest in connection with Lohardaga P.S. Case No. 169 of 2025, registered for the offence under Sections 74, 75, 76, 115(2) and 3(5) of Bhartiya Nyaya Sanhita, 2023, pending in the court of learned Chief Judicial Magistrate, Lohardaga.

Learned counsel appearing for the petitioner submits that there are case and counter case between the parties and first case is lodged by the petitioner. He next submits that due to counter blast, the present case has been lodged and the alleged occurrence is said to be dated 18.08.2025, whereas the FIR has been lodged on 09.09.2025, after delay of 21 days. He further submits that there are dispute with regard to parking of the vehicle. He next submits that co-accused person has been granted anticipatory bail in ABA No.2960 of 2026. On these grounds, he

submits that anticipatory bail may kindly be granted.

Learned counsel appearing for the State opposes the prayer and submits that the allegations are there of outraging modesty. On this ground, he submits that anticipatory bail may kindly be rejected.

Considering that first case is lodged by the petitioner and further one person of the petitioner side has received injury and the alleged occurrence is said to be of 18.08.2025, whereas the FIR has been lodged on 09.09.2025 and there are case and counter case between the parties and there is land dispute between the parties for parking space and the co-accused person has been granted anticipatory bail as aforesaid, in the attending facts and circumstances, I am inclined to grant anticipatory bail to the petitioner.

Accordingly, the above-named petitioner is directed to surrender before the learned court within two weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lohardaga, in connection with Lohardaga P.S. Case No. 169 of 2025, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
