Heard Mr. Amrito Das and Mr. Ayush Mittal, learned counsel for the petitioner. Also heard Mr. Shashank Thakur, learned Additional Advocate General, appearing for the State/respondent Nos. 1 to 4 and Mr. H.S. Ahluwalia, learned counsel, appearing for respondent No.11 / Municipal Council, Manendragarh. 2. The present Public Interest Litigation has been filed by the petitioner seeking following reliefs : “10.1 To call for the records of the case for the kind perusal of this Hon'ble Court. 3 10.2 To issue an appropriate writ or order and declare that the inaction and omissions on the part of res.no.3 is bad in law, arbitrary and liable to be quashed. 10.3 To issue an appropriate writ or order and direct the official respondents to take necessary action in accordance with law in consonance to the provisions contained under the 'Act of 1973', 'Rules of 2013' and the Municipalities Act, 1961. 10.4 Any other relief deemed fit in the facts and circumstances of the case may also be granted.” 3. Learned State counsel as well as learned counsel, appearing for respondent No.11 / Municipal Council, Manendragarh submit that a complainant has already been filed under Section 313 of the Municipalities Act, 1961 against 12 persons on 29.07.2024. It is further submitted that on 30.07.2024, the learned Chief Judicial Magistrate, Manendragarh at Korea fixed the case for arguments on the point of registration of the complaint on 20.08.2024; however, till date, the complaint has not been registered. 4. Considering the fact that the compliant under Section 313 of the Municipalities Act, 1961 against 12 persons has already been filed on 29.07.2024 before learned Chief Judicial Magistrate, Manendragarh at Korea, we direct the learned Chief Judicial Magistrate to proceed with the case expeditiously at it appears from the order sheet dated 30.07.2024 that the case was for argument before registration of the complainant on 20.08.2024, thereafter, nothing has been done. 4 5. The Municipal Council, Manendragarh shall take all initiatives to get the case decided to its logical end expeditiously. 6. With the aforesaid observation and direction, the instant petition stands disposed of. 7. A copy of this order be placed before the Magistrate concerned by learned counsel, appearing for the Municipal Council within a period of two weeks. 8. Registrar (Judicial) of this Court shall also send a copy of this order to the concerned Magistrate for necessary information and compliance forthwith.
