Hon’ble Shri Bibhu Datta Guru, Judge Order on Board 15/05/2026
1. By the present writ petition, the petitioner has prayed for following reliefs:-
“A) This Hon'ble Court may kindly be pleased to Issue an appropriate writ /order/direction quashing the impugned Transfer Order dated 14.01.2026 issued under SCT-2026 transferring the petitioner from 241 Battalion CRPF, Jagdalpur, Chhattisgarh to 232 (Mahila) Battalion CRPF, Salboni, West Midnapore, West Bengal; B) Issue an appropriate writ/order/direction quashing the rejection order dated 19.02.2026 whereby the representation submitted by the petitioner has been rejected; C) Direct the respondents to allow the petitioner to continue at 241 Battalion CRPF, Jagdalpur in accordance with the policy applicable to Bastariya personnel and the extension granted upto SCT-2027; D) Grant interim protection by staying the effect and operation of the impugned transfer order dated 14.01.2026 during pendency of the present petition; and E) Pass any other relief that this Hon'ble Court may deem fit and proper in the interest of justice.”
2. Learned counsel for the petitioner submits that the petitioner
3 was appointed as a Constable (Hairdresser) in a special recruitment drive and was posted at 241 Battalion CRPF (Bastariya Battalion), Jagdalpur, District Bastar, Chhattisgarh.
It is submitted that the tenure of the said Battalion was upto SCT- 2027 (Summer Chain Transfer 2027), as reflected in Annexure P-2. However, the petitioner has been transferred to 232 (Mahila) Battalion CRPF, Salboni, West Midnapore, West Bengal, on the ground of the transfer of the petitioner’s husband, who is also serving in the CRPF. Learned counsel further submits that the petitioner never applied for a coupled transfer, however, vide impugned order dated 14.01.2026, she has been transferred, which is against the principles of violation of the policy applicable to the CRPF. 3. Learned counsel for the respondents submits that the petitioner has completed the tenure of five years, as the deployment in the Bastariya Battalion was only for a period of five years, and therefore, upon completion of the said tenure, the petitioner has been transferred. 4. I have heard learned counsel for the parties, perused the pleadings and documents. 5. From a perusal of Annexure P-2, it appears that the period of deployment of the Bastariya Battalion has been extended till
2027. However, though the petitioner had submitted a representation before the competent authority, the same has been rejected by a non-speaking order. Hence, the petitioner is
4 permitted to approach respondent No. 3 by filing a fresh representation within a period of ten days from today. Upon such representation being filed, the respondent No.3/Inspector General, CRPF, is directed to consider and decide the same in accordance with Annexure P-2 and pass a necessary order within a further period of fifteen days. Till then, the impugned transfer order transferring the petitioner shall remain stayed. 6. With the aforesaid observation and direction, the present petition is disposed of. SD/-
