Learned counsel for the applicant would submit that out of 12 prosecution witnesses, only 2 witnesses have been examined by the trial Court upto 23.02.2026, in the meanwhile, more than two and half months have already been elapsed more evidence would have already been recorded by the trial Court. 2. Considering the aforesaid submissions and taking into account the fact that the trial is at the stage of recording of prosecution evidence, this Court does not deem it appropriate to examine the merits of the case on the basis of evidence available on record at this stage.
