Sinha, Advocate ---- 02/17.07.2026 This petition has been filed for modification of order dated 14.05.2026 passed in A.B.A. No. 2570 of 2026. 2. Learned counsel for the petitioner submits that in terms of the order dated 14.05.2026 passed in A.B.A. No. 2570 of 2026 the petitioner has gone to surrender before the learned Court on 23.05.2026 as disclosed in paragraph No.6 of the petition. He further submits that however in the order the name of the petitioner was shown as X as the petitioner happened to be relative of the victim and only because the name of the petitioner was not reflected in the order the learned Court has not accepted the bail bond. He then submits that although the petitioner is sole accused in the said FIR. He next submits that in view of the order of the Hon’ble Supreme Court and further as per the notification No.23/2024/R&S/JHC dated 20.12.2023 of the High Court the name of the petitioner was not disclosed in the petition. He also submits that the learned Court has also not taken pain of examining the FIR to come to the conclusion 2026:JHHC:21096 --2-- Cr.M.P. No. 1789 of 2026 that the petitioner is sole accused in the said FIR. On these grounds, he submits that two weeks’ further time may kindly be extended to surrender before the learned Court. 3. Learned counsel for the State submits that the learned Court was required to examine the FIR if the petitioner was before the learned Court. 4. In view of the aforesaid facts and submission of learned counsel appearing for the petitioner and looking into the FIR it transpires that the name of sole accused is Madhusudan Tripathy. 5. Further in light of the above facts and considering that the learned Court has refused to accept the bail bond of the petitioner, further two weeks’ time from today is extended to surrender before the learned Court. 6. Order dated 14.05.2026 passed in A.B.A. No. 2570 of 2026 is modified to the above extent. 7. Rest of the orders are kept intact. 8. This Cr.M.P. is disposed of. (Sanjay Kumar Dwivedi, J.)
