This bail application has been filed under Section 483 of BNSS, on behalf of the petitioner, who has been arrested in connection with FIR No.01/2025 registered at Police Station Kumher, District Deeg for offences punishable under Sections 115(2), 126(2) & 189(2) of Bhartiya Nyaya Sanhita (in short, ‘BNS’), 2023. During the course of investigation, offences punishable under Sections 115(2), 126(2), 190(2) & 3(5) of BNS, 2023 have been found proved against the petitioner. 2. It is contended by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. Learned counsel contends that cross cases have been registered between the parties. It is contended that according to the statement of son of injured, main allegation of causing head injury is against co- accused- Neelu. Learned counsel submits that the petitioner [2026:RJ-JP:2940] (2 of 3) [CRLMB-16393/2025] himself sustained injuries for which he remained hospitalized for four days. It is submitted that the petitioner is in custody since 30.11.2025 and further custody of the petitioner would not serve any fruitful purpose. 3. Per contra, learned Public Prosecutor assisted by learned counsel for the complainant vehemently oppose the submissions advanced on behalf of the petitioner. It is submitted that, in the supplementary statement of the injured, an allegation has been made against the petitioner of causing an injury to the head of the injured. 4. At this stage, learned counsel for the petitioner submits that in earlier statement of victim/injured, there is no allegation against the petitioner of causing injury on the head of the injured. 5. Heard. Perused the material available on record. 6. Having regard to the totality of the facts and circumstances; considering the arguments advanced by learned counsel for the parties, especially considering the fact that cross cases have been registered between the parties, as also the fact that petitioner himself sustained injuries, so also the fact that as per FIR and statement of son of injured, main allegation of causing head injury is against co-accused Neelu and trial will take considerable time in its conclusion as well as looking to the custody period, but without expressing any opinion on merits/demerits of this case, I deem it proper to allow the bail application. 7. This bail application is accordingly allowed and it is directed that accused-petitioner - Surendra S/o Late Shri Ramdev Singh, shall be released on bail provided he furnishes a personal [2026:RJ-JP:2940] (3 of 3) [CRLMB-16393/2025] bond in the sum of Rs.1,00,000/- (Rupees One Lakh Only) together with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand Only) each to the satisfaction of the learned trial Court with the stipulation that he shall appear before that Court and any Court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so. 8.
