Ramkaran, Aged About 36 Years, R/o Village Khanga Ka Bas, Post Derwala, Police Station Sadar, District Jhunjhunu At Present Confined At Central Jail, Jaipur. 2. Kashmeer Jhajhdiya S/o Sh. Nemi Chand Jhajhdiya, Aged About 26 Years, R/o House No. 11/220, New Housing Board, Police Station Kotwali, District Jhunjhunu. At Present Confined At Central Jail, Jaipur. ----Petitioners Versus State Of Rajasthan, Through Its Pp ----Respondent For Petitioner(s) : Mr. Rajesh Goswami Mr. Shiv Kumar Jangir For Respondent(s) : Mr. Devi Singh, PP HON'BLE MR. JUSTICE PRAMIL KUMAR MATHUR Order 19/01/2026 1. The petitioners have preferred this bail application under Section 483 of BNSS in FIR No.42/2025 registered at Police Station Bhatta Basti, District-Jaipur City (North) for offences under Sections 43 and 66 of IT Act, Section 10 (1) of Public Examinations (Prevention of Unfair Means) Act, 2024 and Section 61 (2) (a) of BNS. 2. Heard learned counsel for the petitioners as well as learned Public Prosecutor and perused the material available on record. 3. Learned counsel for the petitioners submits that the petitioners have falsely been implicated in this matter. He further [2026:RJ-JP:2131] (2 of 3) [CRLMB-16275/2025] submits that the allegation against the present petitioners is that they used the “Amy Admin Remote Access App” to facilitate other candidates appearing in the departmental examination conducted by the Railway Protection Force. It is alleged that the petitioners assisted such candidates in the examination. Though one case is reported against petitioner-Kashmeer Jhajhdiya and two cases are reported against petitioner-Sandeep Kumar, in all such cases they have been enlarged on bail. The offences alleged are triable by a Magistrate. Despite this, the petitioners have been behind bars since 17.10.2025 in connection with the alleged facilitation of success in the said examination. Charge-sheet has been filed. The trial of the case may take considerable time, therefore, no fruitful purpose would be served by keeping the petitioners in further custody, hence, the bail application of the petitioners may be allowed. 4. Learned Public Prosecutor has vehemently opposed the bail application. 5. On consideration of the rival submission and material available on record and deliberating all the facts and circumstances of the case, and without expressing any opinion on the merits/demerits of the case, I am inclined to grant benefit of bail to the petitioners. 6. Accordingly, the bail application under Section 483 B.N.S.S. is allowed and it is ordered that the petitioners-Sandeep Kumar S/o Sh. Ramkaran and Kashmeer Jhajhdiya S/o Sh. Nemi Chand Jhajhdiya shall be released on bail on their furnishing a personal bond in the sum of Rs.50,000/- with two sureties of [2026:RJ-JP:2131] (3 of 3) [CRLMB-16275/2025] Rs.25,000/- each to the satisfaction of the learned trial court for their appearance before that Court on all the dates till conclusion of the trial.
