02/ 17.07.2026: Heard learned counsel for the petitioners and learned counsel for the State. 2. The petitioners are apprehending their arrest in connection with Adityapur P.S. Case No.397 of 2023, registered for the offence under Sections 447, 341, 323, 307, 379, 504, 506 and 34 of the Indian Penal Code, pending in the Court of the learned Chief Judicial Magistrate at Seraikella. 3. Learned counsel appearing for the petitioners submits that there are case and counter case between the parties. He further submits that all the family members have been implicated in the case. He then submits that there are general and omnibus allegations against the petitioners. He next submits that the main allegation is there against one Sonu Singh. He also submits that the petitioners are having no criminal antecedent, as disclosed in paragraph 15 of the petition and co-accused has been granted anticipatory bail in A.B.A. No. 821 of 2026
4. Learned counsel appearing for the State opposed the prayer and submits that the allegations of assault are there. ( 2026:JHHC:21029 )
5. On perusal of the FIR, it transpires that the allegation of assault is there against Sonu Singh. So far as these petitioners are concerned, there are general and omnibus allegations. There are case and counter case between the parties. The petitioners are having no criminal antecedent, as disclosed in paragraph 15 of this application and co-accused has been granted anticipatory bail in the aforesaid A.B.A.. 6. In the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioners.
Accordingly, the above-named petitioners are directed to surrender before the learned Court within three weeks from today and in the event of their arrest or surrender, they shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand)each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate at Seraikella in connection with Adityapur P.S. Case No.397 of 2023, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. Dt.17.07.2026
