…...... 13/ 15.07.2026: Heard, learned counsel for the petitioner and learned counsel for the State. 2. This application has been filed for releasing the admitted dues of the petitioner. The amounting to Rs.1,99,58,400/- (Rs. One Crore Ninety-Nine Lakhs Fifty-Eight Thousand Four Hundred Only) inclusive of 12% IGST vide Invoice No.CH/2122/6181 dated
10.01.2022. 3. Petitioner is a private limited company and he is engaged inter- alia in the Healthcare Industry and supplies various diagnostics materials and equipments. 4. It is the case of the petitioner that the petitioner has provided CBNAAT Cartridge to the Central TB Elimination Programme, under
Ministry of Health & Family Welfare, Government of India for several years. After decentralization, it is the State Government who has purchased the materials from the petitioner. The department issued purchase order in favour of the petitioner, the petitioner supply the same. 5. It is grievance of the petitioner is that the purchase price was not released in favour of this petitioner which led to filing of this writ petition. 6. The State initially filed the counter affidavit. Though they had not disputed the fact of supply, but taken the plea that there was no approval of the said supply by the Competent Authority. 7.
Today, during course of argument, it has been brought to the notice of this Court by the learned counsel for the petitioner and also by the State by referring to Annexure-D to the counter affidavit i.e. Notification dated 23.06.2026, that the post facto approval of the purchase order has already been granted by the State Cabinet. 8. In this context paragraph 12 of the Notification mentioned that the State Cabinet has already granted post facto approval in terms of Rule 245 by relaxing Rule 235 of the Finance Rule and have approved purchase of the CBNAAT Cartridge at the rate as fixed by the Central Government. 9. Now since the post facto approval of the purchase order has already been granted and it is an admitted case that the petitioner had supplied the materials, which has been accepted by the respondents and in the counter affidavit there is no complain about the quality of the materials, the amount needs to be disbursed in favour of the petitioner. 10. In this context, the respondents also agreed that the amount needs to be paid to the petitioner. 11. Thus, I direct the respondents to disburse the amount to
the petitioner along with interest @ 6% from the date of supply till the date of payment within a period of eight weeks from the date of receipt a copy of this order. 12. With the aforesaid observation and direction, the instant writ petition is disposed of. (ANANDA SEN, J.) 15th July, 2026 R.S./S.K.C. Uploaded on 18/07/2026.
