SRI ANANDA SEN, J. ------ For the Petitioner(s) : M/s Anurag Kashyap & Rohan Mazumdar, Advocates For the State : M/s Vandana Bharati, Kumari Rashmi and Lily Sahay, A.P.Ps. ------ 08/25.02.2026: These bail applications have been filed under Sections 483 & 484 of BNSS, 2023 wherein, prayer has been made for grant of bail as they are in custody for allegedly committing offence punishable under Sections 319(2), 318(4), 338, 336(3), 340(2) and 3(5) of the BNS, 2023. 2. Heard, learned counsel for the petitioners, learned counsel for the State and have also gone through the impugned order. 3. Learned APPs oppose the prayer for bail of the petitioners. 4. The allegations against the petitioners are that they committed cyber fraud in the name of Google Review/ Rating and in the name of completion of task through WhatsApp and Telegram. They were apprehended at Kharai Gutu Road near forest and from possession of Manik Bhakat (in B.A. No. 9360 of 2025) grey colour iPhone 14 Pro Max (IMEI No.356266760190055) with Mobile No.9942052483 and silver colour Realme 14 Pro+5G (IMEI No.860373066075130) with Mobile No.9279210055 were recovered. From the possession of Chiranjit Bhagat (in B.A. No.10052 of 2025), an orange coloured IQ00 Neo 7Pro with IMEI Page No. 1
2026:JHHC:5838 No. 865199069371510 and mobile number- 9341169946 have been recovered, whereas, from the petitioner- Manthan Bhakat @ Rinku Bhakat (in B.A. No. 10714 of 2025), a red-yellow speckled Redmi 10 Prime with IMEI 1 No. 868480053240458 and mobile number- 9304171266 and mobile number- 6207416380 have been recovered.
From the possession of the petitioner- Kitesh Bhakat @ Khitish Bhakat (in B.A. No. 10714 of 2025) dark colour Moto g64 5G IMEI No.354394266252518 having Mobile No.6203382511 has been recovered. 5. From the record, it appears that several cyber fraud transactions were made from the UPI IDs of the mobiles, which were recovered from the possession of the petitioners. Several online complaints have also been made. From the case diary, it further appears that the money through cyber fraud deposited in the account of Manik Bhakat from several persons for which, online complaints were made and between 01.03.2025 and 15.09.2025 in Bank account No. 5956618210003875, Bank of India, Haldipokhar Branch of Manik Bhakat, total amount Rs.10,89,835.48/- was deposited and Rs.10,79,165.89/- was withdrawn from this account and balance of Rs. 10,669.59/- is left, though, he does not do any work for livelihood. Further, in the account of petitioner- Chiranjit Bhagat, Rs.10,000/- and Rs.5,400/- have been received by way of cyber fraud, for which, online complaint has been made. Similarly, in the account of petitioner- Kitesh Bhakat @ Khitish Bhakat, Rs.1,200/-, Rs.1,500/- and Rs.2000/- have also been received by way of cyber fraud, for which, also online complaints have been made. From perusal of case diary, it further appears that in the account of petitioner- Manthan Bhakat @ Rinku Bhakat, Rs.1,000/- and Rs.3,000/- have been received by way of cyber fraud, for which, also online complaints have been made. 6. Considering the nature of allegations and the aforesaid materials as well as the fact that charge has not been framed, I am not inclined to grant privilege of bail to the petitioners. Accordingly, the prayer for bail of the petitioners, named above, in connection with Kowali P.S. Case No. 36/2025, pending in the Court of learned Judicial Magistrate, 1st Class, Jamshedpur, stands rejected. 7. Accordingly, these bail applications are dismissed.
