Affidavit of service filed in Court today is taken on record. 2. The petitioner is the widow of a retired employee of the West Bengal Transport Corporation Limited who superannuated from service on 31st January, 2005 and expired on 9th February, 2022. She prays for revision of family pension in terms of the memorandum dated 15th February, 2021 issued by the Transport Department, Government of West Bengal. 3. The prayer of the petitioner for revision of family pension is pending consideration before the concerned authority. 4. Learned advocate for the petitioner relies on the order dated 23rd February, 2026 passed by this 2 Court in WPA 18812 of 2025 (Swapan Ghoshal alias Swapan Kumar Ghoshal v. The State of West Bengal & Ors.) wherein a similar issue fell for consideration before the Court. 5. After hearing the parties, the Court was pleased to direct the West Bengal Transport Corporation Limited to grant benefit of the subject memorandum within a specified time period. The Court also directed the said authority to grant interest at the rate of six per cent per annum on the revised pensionary benefit on and from the next date of the subject memorandum i.e., 16th February, 2021. The State respondents were also directed to allot necessary fund to the West Bengal Transport Corporation Limited for making payment. 6. As it appears that the facts of the instant case are similar to the case mentioned hereinabove, accordingly, similar direction is passed in the instant matter. 7. The West Bengal Transport Corporation Limited is directed to grant benefit of the memorandum dated 15th February, 2021 by revising the family pension of the petitioner by applying the methodology as contained in Clause 5 of the said memorandum within a period of eight weeks from the date of communication of this order. 8. As the revision of the pensionary benefit ought to have been taken immediately upon publication 3 of the subject memorandum, but the same has not been taken till date, accordingly, the petitioner shall be provided simple interest on account of such delayed payment of the revised family pension amount at the rate of six per cent per annum calculated on and from 16th February, 2021 till the date of actual payment. The revised family pension shall be paid along with interest. 9. The State respondents are directed to allot necessary fund to the West Bengal Transport Corporation Limited for making the payment to the petitioner in terms of the direction passed hereinabove. 10. The writ petition stands disposed of. 11. All parties shall act on the basis of a server copy of this order duly downloaded from the official website of this Court. 12. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Amrita Sinha, J.)
