5. The marriage of the petitioner no.1 and respondent no.2 was solemnised on 16th January, 2013 as per Hindu rites and ceremonies. 6. Matrimonial disputes arose between the petitioner no.1 and respondent no.2, which resulted in the filing of the present FIR on 7th July, 2015 by the respondent no.2 against the petitioner. 7. Now, the parties have settled their disputes in terms of the settlement agreement dated 11th October, 2019, which has been placed on record as Annexure P-2 to the petition. 8. In terms of the settlement, a decree of divorce dated 31st August, 2021 has been granted with the mutual consent of the parties. The amount of Rs. 1,50,000/- was payable by the petitioner no.1 to the respondent no.2, out of which Rs.1,00,000/- has already been paid. 9. The demand draft for balance amount of Rs.50,000/- has been handed over in Court to the respondent no.2. 10. The respondent no.2 is present in Court and has been identified by the Investigating Officer (IO). She informs the Court that she has settled the matter of her own free will and without any coercion.
She further states that she has no objection to quashing of the FIR. 11. The petitioners are also present in Court and have been identified by their counsel. They affirm the statement of respondent no.2 and undertake to abide by the terms of settlement arrived at between the parties. 12. Considering the above settlement between the parties, there is no use continuing with the proceedings of the present FIR, as it would be an unnecessary burden on the State exchequer. Hence, it would be in the interest of justice to quash the aforementioned FIR and the proceedings pursuant thereto. This is a digitally signed order.
