The grievance of the petitioner is directed against wrongful and illegal encroachment upon the property of the petitioner by the private respondent. The writ petition was filed in the year 2021 and has been adjourned from time to time. It is submitted on behalf of the petitioner, upon instruction, that they do not want to proceed with the writ petition and have availed of alternative remedy by filing a civil suit. CESC is represented. In view of the above, WPA 11772 of 2021 along with connected interlocutory application stands dismissed.
