( 2026:JHHC:21145 ) IN THE HIGH COURT OF JHARKHAND AT RANCHI Cr.M.P. No. 1697 of 2026 ------ Dasa Nag @ Dasai Nag @ Suleman Nag, aged about 30 years, son of Bichuray Nag, resident of Village-Mailburu, P.O. & P.S.-Murhu, Dist.-Khunti … Petitioner Versus The State of Jharkhand … Opposite Party ------ CORAM: HON’BLE MR. JUSTICE ANIL KUMAR CHOUDHARY ------ For the Petitioner : Mr. Abhay Kr. Chaturvedy, Advocate For the State : Mr. Fahad Allam, Addl. P.P. ------ Order No.03 Dated- 17.07.2026 Heard the parties. This criminal miscellaneous petition has been filed at the instance of the petitioner for restoration of B.A. No. 1732 of 2026 to its original file. Learned counsel for the petitioner submits that B.A. No. 1732 of 2026 was dismissed for non-compliance of the peremptory order of filing supplementary affidavit. It is next submitted that as the petitioner was not informed about the stipulated time; as he was living in remote area of District Khunti, hence the said supplementary affidavit could not be filed within the stipulated time and the same resulted in dismissal of B.A. No. 1732 of 2026. It is further submitted that non-compliance of peremptory order was neither deliberate nor intentional. It is next submitted that the petitioner has very good grounds to agitate in the said B.A. No. 1732 of 2026 and unless B.A. No. 1732 of 2026 is restored to its original file, the petitioner will be highly prejudiced. Hence, it is submitted that B.A. No. 1732 of 2026 be restored to its original file. Considering the aforesaid submission of the learned counsel for the petitioner, B.A. No. 1732 of 2026 is restored to its original file to the stage at which, it was before its dismissal. List B.A. No. 1732 of 2026 under the appropriate heading before the appropriate bench after a week. (Anil Kumar Choudhary, J.) 17.07.2026 Gunjan-
