HC-KAR NC: 2026:KHC:17478 WP No. 10974 of 2025 ORAL ORDER In this petition, petitioners have sought for the following reliefs; a] ISSUE a writ in the nature of mandamus directing the 1st Respondent to pay the pension and pensionary benefits to the Petitioners from the date of their retirement in terms of the order passed by the co-ordinate bench of this Hon'ble court in Writ Petition No.33347/2019 dated 2.4.2024 and Writ Petition No.3001/2021 C/w Writ petition.No.24015/2021 & Writ Petition No.15999/2024 dated 16.12.2024 at ANNEXURE-R and R1 under the facts and circumstances of the case; and b] ISSUE any other appropriate writ, order or orders or direction as this Hon'ble court may deems fit to grant under the facts and circumstances of the case, in the interests of justice."
2. Heard learned counsel for the petitioners and learned AGA for 1st respondent as well as learned counsel for 2nd respondent and perused the material on record.
3. The issue in controversy is directly and squarely covered by the judgment of this Court in the case of Sri.V.Raghavendra & others vs. The State of Karnataka &

"a] ISSUE a writ in the nature of mandamus directing the 1st Respondent to pay the pension and pensionary benefits to the Petitioners form the date of their retirement in terms of the order passed by the co-ordinate bench of this Hon'ble court in Writ Petition No.33347/2019 dated 2.4.2024 and Writ Petition No.3001/2021 C/w Writ Petition No.24015/2021 & Writ Petition No.15599/2024 dated 16.12.2024 at ANNEXURE-R and R1 under the facts and circumstances of the case; and b] ISSSUE any other appropriate writ, order or orders or direction as this Hon'ble court may deems fit to grant under the
facts and circumstances of the case, in the interests of justice."

Learned counsel for the petitioners submits that the present petition may be treated as a representation by directing respondent No.1 to consider the claim of the petitioners bearing in mind the orders passed by this Court and the Hon'ble Apex Court in the cases of (i) Sri Sunderram and others v. The State of Karnataka and another [Writ Petition No.33347/2019 dated 02.04.2024]; (ii) M.Janardhana Reddy and others v. The State of Karnataka and another [Writ Petition No.3001/2021 C/w Writ Petition No.24015/2021 & Writ Petition No.15599/2024 dated 16.12.2024]; (iii) D.Krishna Reddy v. State of Karnataka and another [Writ Petition No.38872/2016 C/w Writ Petition No.38870/2016] and (iv) The State of Karnataka and another v. D.Krishna Reddy [SLP Nos.21540-21541/2017] in accordance with law within a stipulated time frame.

3. Per contra, learned AGA submits that if reasonable time is granted, respondent No.1 will consider the claim of the petitioners and pass appropriate orders in accordance with law.
4. Submission is placed on record.
5. In view of the aforesaid facts and circumstances and submissions made by both sides, I deem it just and appropriate to dispose of this petition directing respondent No.1 to address the grievances of the petitioners and consider and pass appropriate orders/take appropriate decision within a period of three months from the date of receipt of a copy of this
order bearing in mind the orders passed by this Court and the Hon'ble Apex Court referred to supra and in accordance with law.
3. Under these circumstances, I deem it just and appropriate to dispose of this petition by directing the 1st respondent to address the grievances of the petitioners and consider and pass appropriate orders / take appropriate decision within a period of three months from the date of receipt of a copy of this order in accordance with law, bearing in mind the order passed by this Court in V.Raghavendra’s case supra and the judgments of the Apex Court referred to therein.
