02/20.01.2026 Heard learned counsel appearing for the petitioner and learned counsel appearing for the State.
2. The petitioner is apprehending his arrest in connection with Godda (Muffasil) (Motiya O.P.) P.S. Case No.336/2022, registered for the offence under Sections 147, 148, 149, 341, 342, 323, 332, 333, 337, 338, 307, 353, 504 of the IPC, pending in the Court of the learned C.J.M., Godda.

Learned counsel appearing for the petitioner submits that the petitioner had earlier moved before this Court in A.B.A. No.05/2024, which was dismissed by this Court vide order dated 12.02.2024. He next submits that thereafter, the petitioner has moved before the learned Sessions Judge and the bail petition of the petitioner along with Niranjan Yadav has been rejected by the learned Sessions Judge. He also submits that the said Niranjan Yadav has thereafter moved before this Court in A.B.A. No.7212 of 2025 and he has been granted anticipatory bail vide order dated 18.12.2025. He submits that in view of that, there is changed circumstance and, as such, the anticipatory bail may kindly be granted to the petitioner. He then submits that there are general and omnibus allegations against the petitioner and at the place of occurrence, 2000 people were assembled. He further submits that

the petitioner has got no criminal antecedent, as disclosed in paragraph 12 of this application.

Learned counsel appearing for the State opposed the prayer and submits that the allegations are there of assault upon the police official.
5. It transpires that by the order of the learned Sessions Judge, the prayer for anticipatory bail of Niranjan Yadav was also rejected and this Court vide
order dated 18.12.2025 granted anticipatory bail to Niranjan Yadav in A.B.A. No.7212 of 2025. In view of that, there is changed circumstance and, therefore, second anticipatory bail application can be entertained. Further, the allegations are there against 2000 persons of assembling and indulging in hooliganism. The petitioner has got no criminal antecedent, as disclosed in paragraph 12 of this application. In the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner.

Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Godda in connection with Godda (Muffasil) (Motiya O.P.) P.S. Case No.336/2022, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
