Heard Mr. L. Gogoi, the learned counsel appearing for the petitioners. Also heard Mr. D. Gogoi, the learned Special Public Prosecutor for Wildlife. 2. Both these applications are filed under Section 483 of the BNSS, 2023 in respect of Offence No.ER 03/2025 in the office of the Range Forest Officer, Eastern Range, Gamiri, Biswanath under Sections 9, 27, 49(b), 51 and 51 of Wildlife (Protection) Act, 1972 and Wildlife Protection (Assam Amendment) Act, 2009. Page No.# 3/3 3. The petitioners were found making a plan to kill Rhino inside the forest. The petitioners Sri Ranoj Pegu, Sri Bimal Pachung and Sri Birgu Pegu have already spent 65 days in judicial custody, while the petitioner Girish Pegu has spent 60 days in judicial custody. 4. Mr. Gogoi has submitted that no charge sheet has been filed till date. 5. This Court is of the opinion that the petitioners, named above, deserve to be given default bail. Accordingly, their bail applications are allowed. 6. The petitioners namely, Sri Ranoj Pegu, Sri Bimal Pachung, Sri Birgu Pegu in Bail Application No.288/2026 and the petitioner Girish Pegu in Bail Application No.231/2026 shall be released on bail of ₹25,000/- each with sureties of like amount to the satisfaction of the learned Sub-Divisional Judicial Magistrate (M), Gohpur, however, if they are not required in any other case(s).
