The petitioners are apprehending their arrest in connection with Lawalong PS Case No.5 of 2026, for offence registered under section 18, 27(a), 28, 29, 30 of NDPS Act and Section 33 of the Indian Forest Act, pending in court of learned Sessions Judge Cum Special Judge, NDPS Cases, Chatra.

Learned counsel for petitioners submits that false allegations are made against the petitioners of cultivation of poppy plants in the forest land. He next submits that the petitioners are poor villagers and they are having no criminal antecedent as disclosed in paragraph no.23 of the petition. He next submits that several co-accused persons have been granted anticipatory bail in light of Annexure nos.3 and 4 annexed with the petition.
4. Learned State counsel opposes prayer and submits that

allegations are there of cultivation of poppy plants in the forest land.

Considering that the land is of the forest department and is not belonging to the petitioners and the petitioners have got no criminal antecedents and the co-accused persons have been granted anticipatory bail as aforesaid, I am inclined to grant anticipatory bail to both the petitioners.
6. Accordingly, both the petitioners, above named, are hereby
directed to surrender before learned court within three weeks from today, and in event of their surrender/arrest, both the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Sessions Judge Cum Special Judge, NDPS Cases, Chatra, in connection with Lawalong PS Case No.5 of 2026, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
