Order on Board 21/05/2026 1 The applicant has preferred this first bail application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, the BNSS) for grant of regular bail, as he has been arrested on 06.04.2026 in connection with Crime No.44/2026, registered at Police Station Tamnar, District Raigarh, Chhattisgarh, for the offences punishable under Section 20(B) of the Narcotic Drugs and Psychotropic Substances Act, 1985. 2 Case of the prosecution, in brief is that on receiving a secret information that some persons on a motor cycle without number plate were carrying contraband article (Ganja) and were going from Hameerpur towards
2 Patthalgaon. On the said information, the police seized the contraband Ganja from the co-accused Naresh Yadav and Surendra Kumar Rajwade, total weighing 12.410 KGs upon which the FIR bearing Crime No. 44/2026 was registered by the police. On the basis of memorandum of the co-accused, the applicant was also made accused in this case. 3 After arguing for sometime, Mr. Sanjay Agrawal, learned counsel for the applicant seeks permission of this Court to withdraw the present bail application with liberty to repeat prayer at an appropriate stage. 4
Learned counsel appearing for other side has no objection. 5 In view of the above, the present bail application is dismissed as withdrawn, with liberty as aforesaid. Sd/-
