CORAM : HON’BLE MR. JUSTICE SANJAY KUMAR DWIVEDI
------ For the Petitioner : Mr. Jeetendra Kumar Mishra, Advocate. For the State
: Mrs. Priya Shrestha, A.P.P. ------
03/ 17.07.2026 This petition has been filed for modification of the order dated 28.01.2026, passed in A.B.A. No. 443 of 2026 by this court.
2.
Learned counsel for the petitioner submits that the petitioner has been taken into custody in another case and due to that reason, he has not been able to surrender before the learned court within the stipulated time. He next submits that further two weeks’ time may kindly be allowed to the petitioner to surrender before the learned court.
3.
Learned A.P.P. for the State shas opposed the prayer and submits that the anticipatory bail was provided to the petitioner on 28.01.2026 on the submission of learned counsel for the petitioner that the petitioner was having no criminal antecedent, however, on the said date, the petitioner was already taken into custody in connection with Bashisthanagar P.S. Case No. 107 of 2025. On this ground, she submits that further time for surrender may not be provided to the petitioner.
4.
Considering that the false submission was made for obtaining the anticipatory bail, as on 28.01.2026, the petitioner was already in custody. As such, no case of extension for surrender is made out. Accordingly, this petition is dismissed.
