Opposite Parties ----- CORAM HON’BLE MR. JUSTICE RAJESH SHANKAR ----- For the Petitioner: Mr. Ramawatar Choubey, Advocate For the O.Ps: Ms. Shalini Sahdeo, A.C to S.C (L&C)-I ----- 12/17.07.2026 The present contempt application has been filed against the opposite parties alleging wilful disobedience and non-compliance of the order dated 20.11.2019 passed by this Court in W.P.(C) No. 6322/2008. 2. Ms. Shalini Sahdeo, learned A.C to S.C (L&C)-I, refers to the order dated 03.01.2026 passed by the present Circle Officer, Simariya in Misc. Case No. 35/25-26 (Annexure-A to the show cause affidavit dated 08.01.2026) and submits that vide the said order, the petitioner’s claim over the land in question has been re-considered and the ‘Raiyati Manyata’, as requested by him, has been refused. 3. It is thus submitted that the aforesaid order of this Court has now been complied. 4. As against this, Mr. Ramawatar Choubey, learned counsel for the petitioner, submits that the order dated 03.01.2026 passed by the present Circle Officer, Simariya suffers from non-application of mind and the petitioner’s claim over the land in question has not been considered in true perspective. 5. Be that as it may. 6. Since in compliance of the aforesaid order of this Court, an appropriate order has already been passed by the present Circle Officer, Simariya, there is no need to further proceed with the matter. 7. The contempt proceeding as against the opposite parties is dropped. 8. The present contempt application stands disposed of. 2026:JHHC:21091 9.
