…. Petitioner Mr. D.N. Rath,Adv.
-versus-
State of Odisha & Another
…. Opposite Parties Mr. Amitav Mishra, Adv. on behalf of Mr. S. Palit, Sr. Adv. (for O.P. No.2)
COROM:
THE HON’BLE MR.JUSTICE BIRAJA PRASANNA SATAPATHY
Order No
ORDER 12.06.2026
2. 1. This matter is taken up through Hybrid Mode.
2. Heard learned counsel appearing for the parties.
3. Basing on the instruction Mr. Amitav Mishra, learned counsel for Opp. Party No.2 contended that on the face of the impugned advertisement issued on 19.12.2025, the University has taken a conscious decision to allow the present Petitioner and similarly situated Contractual Guest Faculty members to continue until further orders. Copy of the communication dt.01.01.2026 and further orders issued on 27.05.2026 and on subsequent dates showing continuance of the Petitioners and similarly situated Contractual Guest Faculty in the establishment of Opp. Party No.2 so produced in Court be kept on record.
4. Mr. A. Mishra, learned counsel for Opp. Party No.2 contended that since it has already been decided to allow the present Petitioners to continue on the face of the impugned advertisement issued under Annexure-6, the Writ Petition so made has become infructuous. Copies of the orders so produced in Court are also provided to the learned Counsel appearing for the Petitioners in Court.
5. Having heard learned counsel for the parties and considering the submission made and since it is not disputed by the learned counsel appearing for Opp. Party No.2 that Petitioners and similarly situated Contractual Faculty members have been allowed to continue until further orders, it is the view of this Court that no further order is required to be passed in the Writ Petition. It is open for the Petitioners to assail, if any action is taken with regard to their continuance in future.
6. The Writ Petition accordingly stands disposed of.
