02/ 15.07.2026: Heard learned counsel for the petitioner and learned counsel for the State.
2. The petitioner is apprehending his arrest in connection with Rail P.S. Barkakana Case No. 08 of 2025, registered under sections 115(2), 117(2), 109, 351(2) and (3) of the BNS, 2023, pending in the Court of learned Railway Magistrate Palamu at Daltonganj.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case. She next submits that petitioner was not present in the train and false allegation has been made that petitioner took the victim near gate of rear compartment of the train and pushed her on the ground. On these grounds, she submits that the petitioner may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits that serious allegation is there against the petitioner and the victim received grievous injury.

From perusal of F.I.R, it transpires that there is direct allegation against the petitioner that petitioner took the victim near gate of rear compartment of the train and pushed her on the ground due to which the victim received grievous injury.

In the attending facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the anticipatory bail of the petitioner is hereby rejected.
