Ms. Parul Negi, Advocate, for the respondent. CARP No.88 of 2026 The present application under Section 151 of CPC, has been filed on behalf of the applicant/respondent, objecting to the maintainability of the present petition before this Court, for want of pecuniary jurisdiction. The perusal of the award shows that the amount claimed by the contractor is in the sum of Rs. 67,47,243/- (Rupees sixty seven lakhs, fourty seven thousand, two hundred and fourty three only). As per Notification No. Home-B.B(15)1/2015- Vol-II, dated 2nd May, 2026, Court of District Judge/Additional District Judge shall have original jurisdiction in all commercial disputes, the pecuniary value of which exceeds Rs. 60,00,000/- (Rupees sixty lakhs), but does not exceed Rs. 1,00,00,000/- (Rupees one crore). Since in the present case, the amount claimed by the claimant is in the sum of Rs. 67,47,243/-, therefore, the objection petition is transferred to the Court of learned District Judge, Shimla, District Shimla, H.P., who shall dispose of the same in accordance with law. The parties through their counsel are directed to appear before the aforesaid Court on 17.09.2026. The records be sent to the said Court, forthwith, so as to reach well before the date fixed.
