[2026:RJ-JP:334] (2 of 4) [CRLMB-16363/2025]
2. Learned counsels for the accused-petitioners submit that accused-petitioners have falsely been implicated in this case. They further submit that the specific allegations of causing injuries to injured Sheela is attributed to Kamal Singh. The allegations against the petitioners are omnibus in nature and not specific. There is a land dispute between the petitioners and the complainant’s party. They further submit that petitioners also lodged an FIR against the complainant’s party and petitioner's party also received various injuries. The police after investigation did not find commission of offence(s) under Sections 336, 379, 354 & 452 of IPC. The petitioners are ready and willing to cooperate with the investigation and custodial interrogation of the petitioners are not required, therefore, the anticipatory bail of the accused-petitioners may be allowed. 3. Learned Public Prosecutor vehemently opposes these anticipatory bail applications. He submits that after thorough investigation, police has found presence of the present petitioners at the place of occurrence. The injuries sustained to injured Sheela at her head was found to be dangerous to life, therefore, the anticipatory bail application of the accused-petitioners may be dismissed. 4. Heard and perused the material available on the record. 5. In the FIR, complainant has named as many as 13 persons after investigation, police did not find commission of offence(s) under Sections 379, 336, 452 & 354 of IPC.

In the statements of injured Sheela recorded under Section 161 of Cr.P.C., she has stated that Kamal Singh caused injuries at her head, similarly, the other eye witnesses namely: Mahendra Singh, Bhagwan Singh, Veervati, Sushila, Kamlesh, Laxmi, Hariram, Ram Kishore & Sher Singh have also stated that injuries caused to Sheela at her head was caused by co-accused Kamal Singh. In the second set of evidence, witnesses Fool Singh, Jitendra Singh & Om Singh, in their statements recorded under Section 161 of Cr.P.C. have assigned Sheela’s injuries to the co- accused Shantnu Kumar @ Shantu. The medical jurists, in his first opinion has opined the injuries caused to Sheela as grievous in nature, later on, he opined that the injuries caused to Sheela are dangerous to life, thus, without commenting anything on the merits of the case, I deem it just and proper to allow the anticipatory bail applications of the accused-petitioners. 7. Accordingly, these anticipatory bail applications under Section 482 BNSS are allowed and it is ordered that in the event of arrest of the petitioners namely- 1. Smt. Lalo @ Lalwati W/o Shantanu, 2.
