Ram Lal Mehta vs. Sh. Narender Singh Bhatia”.
2.
Learned counsel appearing on behalf of the Petitioner has strenuously pressed only the aspect of non-consideration of the compact disc [“CD”] by the learned ARC in the Impugned Order, which, according to him, would evidence that the Respondent was, in fact, not carrying on any business from the said premises and that it was only during the pendency of the proceedings that certain goods were sought to be brought into the premises to demonstrate that the This is a digitally signed order. same were occupied.
3. He further submits that the said CD formed part of the Rejoinder filed by the Petitioner.
4.
Learned counsel appearing on behalf of the Respondent submits that, since the scope of challenge in the present proceedings is narrow and the CD does not appear to have been taken into consideration, the matter may be remanded to the learned ARC for the limited purpose of considering the same.
5. In view thereof, the matter is remanded to the learned ARC for
consideration of the contents of the aforesaid CD. The Respondent shall be at liberty to file such response or pleadings as may be necessary to controvert the contents thereof.
6. The learned ARC shall thereafter consider the said CD and pass an appropriate order in accordance with law. The aforesaid exercise is requested to be completed within a period of three (03) months from today.
7. In view thereof, the present Petition, along with pending application(s), if any, stands disposed of.
8. List before the learned ARC on 09.10.2026.
