This is an application filed under Section 483 of the BNSS, 2023 in connection with Special POCSO Case No. 76/2025 arising out of North Lakhimpur P.S. Case No. 126/2025 registered under Section 87/64 of BNS r/w Section 4 POCSO Act, which is pending before the Court of learned Special Judge (POCSO), Lakhimpur, North Lakhimpur. Mr. R.J. Baruah, learned Addl. Public Prosecutor is present and objects to the bail. Ms. T. Parashar, learned Amicus Curiae submitted that even before the trial court, the victim and the informant had objected to the bail of the petitioner. The TCR reveals that statements of two witnesses have been recorded and the petitioner has been implicated. Having regard to the stage of the trial and upon due consideration of the facts and circumstances, this Court is not inclined to grant bail at this point of time to the petitioner.
