S. Bhanumathi ...Petitioner ...Respondents Rao, Standing Counsel for Agricultural 54 BSB, J W.P.No.11369 of 2023 and batch COMMON ORDER: These writ petitions consist of two batches of reliefs. One set of writ petitions challenge G.O.Ms.No.85 (Agriculture & Co-operation (Mktg.II) Department, dated 06.11.2020, and consequent notices issued to the writ petitioners and the other set of writ petitions challenge the same G.O.Ms.No.85 and the subsequent memo, dated 16.04.2023, rejecting the representation of the Associations to withdraw G.O.Ms.No.85, dated 06.11.2020, and consequent action of the respondents. 2. Exercising power conferred by Section 32 of the Andhra Pradesh (Agricultural Produce and Livestock) Markets Act, 1966, (hereinafter referred to as the ‘Act, 1966’) the government vide G.O.Ms.No.1178, Food & Agriculture (Mktg-I) Department, dated 11.09.1992, issued notification with regard to procedure for issue of licence to the commission agents in the state of Andhra Pradesh and their functioning as commission agents, prescribing security deposit for issuance of licence to the trader / commission agents for using market yard. 3. A number of writ petitions were filed in the High Court challenging the orders issued in the aforesaid government order. Several Agricultural Market Commission Agents Associations, Chambers of Commerce and Merchants Associations have also represented for withdrawal of G.O.Ms.No.1178, dated 11.09.1992. Therefore, modifying the aforementioned G.O., the government issued G.O.Ms.No.190, Agriculture & Cooperation (Mktg.I) Department, dated 06.04.1994, for issue of licences to commission agents and their functioning as commission agents, prescribing different amounts of security deposit depending on the turnover and the nature of commodity as follows: - 55 BSB, J W.P.No.11369 of 2023 and batch Security Deposit for commission agent Turnover of the commission agent (per annum) Rs.20,000/- Rs.10,00,000/- and above Rs.5,000/- Less than Rs.10,00,000/- Rs.1,000/- C.A. dealing in vegetables 4. Commission agent applying for fresh licence shall declare likely turnover of the agent per annum and deposit the amount accordingly. If the turnover exceeds the said limit, the commission agent shall deposit additional amount immediately after receipt of the notice from the market committee failing which the licence shall be liable to be cancelled. The security deposit in respect of old licences would be collected in two installments. The amount of deposit is determined basing on the turnover of the preceding year. In case of change in the amount of turnover, the licensee shall deposit additional amount demanded by A.M.C. No licence shall be renewed unless the additional amount is deposited. 5. Subsequently, G.O.Ms.No.431, Agriculture and Cooperation Department, dated 26.06.1995 was issued. 6. Thereafter, in supersession of the orders issued in G.O.Ms.No.190, dated 06.04.1994, G.O.Ms.No.260, Agriculture and Cooperation (AM.IV) Department, dated 28.09.2010, was issued revising the guidelines to be followed for issue of licences to commission agents and for their functioning as Commission Agents by categorizing the regulated markets into ‘A’, ‘B’ and ‘C’ depending on the volume of the trade of the market committee. Paragraphs Nos.3 and 4(a) &(b) of the G.O. is summarized as follows: 56 BSB, J W.P.No.11369 of 2023 and batch Grade of Market Market Fee of Market Committee Deposit with market committee as security deposit for issue of licence to commission agent Applicant shall mortgage the following worth of property to the market committee (or) provide a bank guarantee in any nationalised bank as collateral security ‘A’ Not less than Rs.3 Crores Rs.2.50 lakhs Rs.15 lakhs ‘B’ Not less than Rs.55 lakhs and not more than Rs.3 Crores Rs.1.50 lakhs Rs.5 lakhs ‘C’ Less than Rs.55 lakhs Rs.1.00 lakh Rs.2 lakhs 7. In addition to the security deposit, the collateral security shall be provided. The other major aspects in the above said G.O. are not relevant for the purpose of the present batch of writ petitions. 8. The government, amending paragraph No.4(a) and (b) of G.O.Ms.No.260, dated 28.09.2010, by substitution, issued certain guidelines vide G.O.Ms.No.49, Agriculture and Cooperation (AM.IV) Department, dated 27.03.2012, reducing the security deposit and collateral security deposit as shown below and further ordering that the security deposit be allowed to be paid through National Savings Certificate duly pledged with the Market Committee as was done earlier as per the orders in G.O.Ms.No.431, dated 26.06.1995. Grade of Market Deposit Collateral Security ‘A’ Rs.1.00 lakh Rs.2 lakhs ‘B’ Rs.0.75 lakhs Rs.1.50 lakhs ‘C’ Rs.0.50 lakh Rs.1 lakh Fruits and vegetables Rs.0.50 lakhs Nil 57 BSB, J W.P.No.11369 of 2023 and batch 9. The government issued G.O.Ms.No.17, Agriculture and Cooperation (AM.IV) Department, dated 31.03.2013, by substitution, amending paragraphs Nos.3 and 4(a) & (b) of G.O.Ms.No.260, dated 28.09.2010, as summarized below, with the same condition of allowing security deposit paid through National Savings Certificates. Grade of Market Market Fee of Market Committee (In Crores of rupees) Deposit with market committee as security deposit for issue of licence to commission agent Applicant shall mortgage the following worth of property to the market committee (or) provide a bank guarantee in any nationalized bank as collateral security ‘A’ Above 20 Rs.10 lakhs Rs.25 lakhs ‘B’ Above 10 & below 20 Rs.5 lakhs Rs.15 lakhs ‘C’ Above 5 & below 10 Rs.3 lakhs Rs.9 lakhs ‘D’ Above 3 & below 5 Rs.2 lakhs Rs.6 lakhs ‘E’ Above 1 & below 3 Rs.1 lakh Rs.3 lakhs ‘F’ Below1 Rs.0.50 lakh Rs.1 lakh 10. Revising G.O.Ms.No.17, dated 31.01.2013, the government issued orders vide G.O.Ms.No.64, Agriculture & Cooperation (AM.IV) Department, dated 11.06.2013, directing that all the commission agents’ licences which were issued prior to the G.O.Ms.No.17, dated 31.01.2013, be renewed as per the guidelines issued in G.O.Ms.No.190, dated 06.04.1994. Thus, a division is brought between conditions applicable for renewal of licence issued before G.O.Ms.No.190, dated 06.04.1994 and for issuance of new licence or licence issued after G.O.Ms.No.190, dated 06.04.1994. 11. The Guntur Chillies Merchants Associations, in its representation, dated 21.09.2015, requested for renewal of applications by collecting security deposit of Rs.20,000/- only instead of Rs.10,00,000/- plus Rs.25,00,000/- as bank guarantee as prescribed in G.O.Ms.No.17, 58 BSB, J W.P.No.11369 of 2023 and batch dated 31.01.2013. The Commissioner & Director of Agricultural Marketing, Hyderabad, proposed to modify G.O.Ms.No.17 and bring a new criteria by which commission agents have to uniformly pay security deposit and collateral security throughout the State as per the turnover of ‘the agent’ instead of the turnover of ‘the market committee’. Thus, while retaining six slabs prescribed for payment of security deposit and bank guarantee by commission agents, G.O.Ms.No.17, dated 31.03.2013, was modified by issuing G.O.Ms.No.57, Agriculture and Cooperation (AM.II) Department, dated 12.10.2015, changing the criteria from ‘market fee collections by the A.M.Cs.’ to ‘turnover of the commission agents’ and applying the same criteria for fresh and renewal of licences throughout the state, including 292 disputed cases in A.M.C., Guntur. 12. Vide G.O.Ms.No.38, Agriculture & Cooperation (Mktg.I) Department, dated 10.05.2016, amendments were made to the A.P. (Agricultural Produce and Livestock) Markets Rules, 1969 (hereinafter referred to as the ‘Rules, 1969’). Before the amendment, Rule 48 dealt with application for grant of licence under Section 7(1) and fee chargeable therefor; Rule 49 dealt with licence to operate as broker, carting or clearing agent etc., in notified area and; Rule 50 dealt with renewal of licence. After the amendment, Rule 48 deals with grant or renewal of trader licence under Section 7(1-A) and fees chargeable thereof; Rule 49 deals with grant or renewal of licence for commission agent, warehouseman, processor, weighman, hamal etc.; Rule 49-A deals with registration of clearing and forwarding agent and; Rule 50 has been omitted. The other amendments are not relevant for the purpose of the present writ petitions. 59 BSB, J W.P.No.11369 of 2023 and batch 13. Challenging G.O.Ms.No.57, dated 12.10.2015, a batch of writ petitions vide W.P.Nos.8562, 8701, 8737, 10053, 10055, 10113, 10177, 11110, 11181, 11191 and 12222 of 2018 were filed. In all these writ petitions, the High Court passed interim order as follows: “There shall be interim direction as prayed for, subject to the petitioners giving an undertaking that they would produce bank guarantee in respect of the amounts specified in G.O.Ms.No.57, Agricultural and Cooperation (AM.III) Department, dated 12.10.2015, and the same would be subject to the result of the writ petition.” 14. Pending these writ petitions, the government modified G.O.Ms.No.57, dated 12.10.2015, revising the bank guarantees on the basis of the turnover of the commission agents, vide G.O.Ms.No.85, Agriculture & Cooperation (Mktg.II) Department, dated 06.11.2020. Grade Existing bank guarantee (in Rs.) Revised bank guarantee (in Rs.) Category of licence Turnover of commission agents (Rs. In crores) Security deposit in share of NSC bonds / Cash (Rs. In view of this G.O., passed pending these writ petitions, this High Court closed the above writ petitions on 16.12.2021 leaving it open to the petitioners therein to challenge G.O.Ms.No.85, dated 06.11.2020. The operative portion of the order reads as follows: “In view of the facts and circumstances of the case, all these writ petitions are closed. However, it is open to the petitioners to challenge G.O.Ms.No.85, Agriculture and Cooperation (Mktg.II) Department, dated 06.11.2020, if they are so advised. There shall be no order as to costs.” 16. Consequent to and basing on G.O.Ms.No.85, dated 06.11.2020, the Higher-Grade Secretary, Agricultural Market Committee, Guntur issued separate notices vide Rc.No.399/2018-23, dated 05.11.2022, to the petitioners directing them to pay the balance amount of bank guarantee specified therein to the Chairman, A.M.C., Guntur, within seven (7) days from the date of receipt of the notice, after deducting the amount of bank guarantee paid at the time of renewal of the licence. 17. W.P.Nos.38506, 39292, 39303, 39305, 39313, 39332, 39338, 39339, 39342, 39347, 40163, 40165, 40166, 40168, 40172, 40179, 41007 and 41017 of 2022, and W.P.Nos.313, 318, 321, 721, 8234, 8237 of 2023 were filed before this High Court, challenging the G.O.Ms.No.85, dated 06.11.2020, and consequent notice vide Rc.No.399/2018-23, dated 05.11.2022. “Meanwhile, there shall be an interim suspension of the impugned notice vide R.C.No.399/2018-23, dated 05.11.2022, issued by the respondent No.4 till then.” 61 BSB, J W.P.No.11369 of 2023 and batch 18. The petitioner in W.P. No.503 of 2023 contended that in December, 2022, an application to the Selection Grade Secretary, A.M.C., Guntur, was submitted to renew the licence of the petitioner for the purpose of resuming the operations of the business, but it was refused to be received without submitting a bank guarantee as per G.O.Ms.No.85, dated 06.11.2020. Therefore, this writ petition was filed challenging the said G.O. on the grounds that it is contrary to the provisions of the Act, 1966 as amended by Act 14 of 2015 and the Rules, 1969; that the amount of security deposit mentioned in the G.O.Ms.No.85, dated 06.11.2020 is increased many fold from the amount mentioned in G.O.Ms.No.260, dated 28.09.2010, without any reasonable basis and such amount is oppressive and restrictive of the trade against freedom of trade under Article 19(1)(g) and not falling within the parameters of reasonable restrictions under Article 19(6) of the Constitution of India and has no nexus with the legislative object; and that the G.O. is only to circumvent the order, dated 27.03.2018 passed in W.P.No.8562 of 2018, by which High Court directed the respondents to receive and process the renewal of licences without insisting payment of security deposit as prescribed in G.O.Ms.No.57, dated 12.10.2015. 19. This Court, vide order, dated 05.01.2023, in I.A.No.2 of 2023 in W.P.No.503 of 2023, directed the petitioner to submit application to the Selection Grade Secretary, A.M.C., Guntur, within two (2) weeks from the date of receipt of copy of the interim order and further directed the Selection Grade Secretary, A.M.C., Guntur, to receive and dispose of the application in accordance with law within two weeks thereafter. 20. In compliance of the interim order, the Selection Grade Secretary, A.M.C., Guntur, issued proceedings vide Rc.No.5 of 2023, dated 62 BSB, J W.P.No.11369 of 2023 and batch 28.01.2023, informing the petitioner to submit the application along with relevant documents and bank guarantee at the earliest to that office for grant of commission agent licence as per the Act, 1966 and the Rules, 1969. Challenging this notice, and again G.O.Ms.No.85, dated 06.11.2020, W.P.No.8568 of 2023 was filed seeking to set aside them. 21. Some Market Yard Commission Agents’ Associations submitted representations to the Government in January, February and March, 2023 requesting to withdraw G.O.Ms.No.85, dated 06.11.2020, and to issue fresh order by revising the security deposit and bank guarantee in relation to renewal of commission agents. 22. Pending these representations for consideration, W.P. Nos.4305, 4314, 4336 of 2023 on 20.02.2023 and 6200 of 2023 on 10.03.2023 were filed by the Associations challenging G.O.Ms.No.85, dated 06.11.2020, and aggrieved by inaction for not considering their representations, dated 20.01.2023, 28.01.2023, 30.01.2023, and 16.02.2023, for re-examining G.O.Ms.No.85, dated 06.11.2020. 23. This Court issued another interim direction, dated 27.03.2023, to the respondents to consider the renewal of licence of the commission agents by taking an undertaking affidavit in respect of the amount specified in G.O.Ms.No.85 as the licence of the agents was valid only upto 31.03.2023. Accordingly, the Commissioner & Director of Agriculture and Marketing, Government of A.P. / respondent No.2 issued proceedings, vide No.Legal Cell/W.P.Nos.6200, 4336, 4314 & 4305 of 2023 / 2023, dated 31.03.2023, directing all the Secretaries of A.M.Cs., to take necessary action as per the interim orders passed in I.A.No.1 of 2023, dated 27.03.2023, in W.P.Nos.6200/2023, 4336/2023, 63 BSB, J W.P.No.11369 of 2023 and batch 4314/2023 & 4305/2023, so as to avoid legal complications in the matter. Thus, the licenses have been renewed up to 2028. 24. Meanwhile, on 16.02.2023, and 17.02.2023, the Selection Grade Secretary, A.M.C., Guntur, issued notices vide Rc.No.42 of 2023 under Section 7(1) of the Act, 1966 to several commission agents directing them to get the licence renewed within thirty (30) days, as it was expiring by 31.03.2023, failing which action would be taken as per law. 25. Thereafter, on 10.04.2023, a batch of writ petitions in W.P.Nos.7367, 10667, 11364, 11365,11368, 11369, 11371, 11372, 11374, 11375, 11393, 11428, 11431,11433, 11435, 11438, 11439, 11440, 11442 and 11458 of 2023 were filed by those petitioners who already filed W.P.Nos.39292 of 2022 to 721 of 2023 noted above (except W.P.No.10667 of 2023) before this High Court, challenging the G.O.Ms.No.85, dated 06.11.2020, and consequent notice vide Rc.No.42 of 2023, dated 16/17.02.2023. 26. At the time of admission of these writ petitions, the High Court passed similar interim order on different dates directing the respondents to consider the representations of the Associations within a period of three (3) weeks from the date of receipt of the copy of the order. 27. Consequent to the interim order to consider the representations of the Associations, the Government of A.P. Agriculture & Cooperation (Mktg.II) Department, issued memo No.AGC01-MKTG.OPMIS/79/ 2023, dated 16.04.2023, rejecting the request for issuance of fresh order by withdrawing G.O.Ms.No.85, dated 06.11.2020. 28. As the Secretary and the Director of A.M.C., Guntur / respondents are taking steps pursuant to the memo, dated 16.04.2023, against the 64 BSB, J W.P.No.11369 of 2023 and batch petitioners demanding to deposit the amount as specified in G.O.Ms.No.85, writ petitions, vide W.P.Nos.13346, 18253 and 19694 of 2023 have been filed challenging the G.O.Ms.No.85, dated 06.11.2020 as well as the further action in issuing the memo, dated 16.04.2023, as illegal. 29. In both sets of the writ petitions, G.O.Ms.No.85, dated 06.11.2020, was challenged on the similar grounds as follows: G.O.Ms.No.57, dated 12.10.2015, was issued arbitrarily increasing security deposit for obtaining licences to such an extent that the traders were unable to deposit the specified amount. Therefore, it was challenged by filing writ petitions, vide W.P.No.8562 of 2018 and batch noted above, in which the conditional interim orders suspending G.O.Ms.No.57, dated 12.10.2015, were passed pending disposal of the writ petitions. 30. Pending the writ petitions, the impugned G.O.Ms.No.85, dated 06.11.2020, was issued by the government of A.P. and consequent notices, dated 05.11.2022, in Rc.No.399/2018-2023, were separately issued to the petitioners by A.M.C., Guntur, demanding to furnish bank guarantee as per the G.O.Ms.No.85, dated 06.11.2020, which is contrary to the provisions of the Act, 1966 as amended by the Act 14 of 2015 and the Rules, 1969. The security deposit prescribed in G.O.Ms.No.85, dated 06.11.2020, is disproportionate in nature as it increased the amount of security by many-fold from the previous rates prescribed in G.O.Ms.No.260, dated 28.09.2010, without any reasonable basis for such increase and contrary to the object of the Act, 1966 which aims at regulation of sale and purchase of agricultural 65 BSB, J W.P.No.11369 of 2023 and batch produce and establishment of markets so as to secure remunerative price to the farmers. 31. The increase in the amount of security deposit under the G.O.Ms.No.85, dated 06.11.2020, is not a reasonable restriction under Article 19(6) of the Constitution of India on the fundamental right to freedom of business guaranteed under Article 19(1)(g) of the Constitution of India. The G.O.Ms.No.85 was passed only to circumvent the interim order, dated 27.03.2018, in W.P.No.8562 of 2018 by which the respondents were directed to renew the license without insisting the payment of security deposit prescribed in G.O.Ms.No.57, dated 12.10.2015. Though G.O.Ms.No.85, dated 06.11.2020, is stated to be a modifying / revised government order, in fact, there is no actual change, but a decrease in slabs was prescribed for payment of security deposit payable by the commission agents. The government order as well as the consequent notice are illegal. Therefore, the writ petitions are filed challenging the G.O.Ms.No.85, dated 06.11.2020. 32. In addition to the above, it is further stated in W.P.Nos.13346, 18253 and 19694 of 2023 that G.O.Ms.No.85, dated 06.11.2020, is not in accordance with the Act, 1966 and the Rules, 1969 inasmuch as the commission agents do not come within the purview of ‘turnover’ and further that the requirement of enacting ‘law’ for the purpose of imposing reasonable restriction under Article 19(6) of the Constitution of India on freedom of business, trade etc., under Article 19(1)(g) of the Constitution of India, cannot be fulfilled by executive action in the form of circular or policy decision in terms of Article 162 of the Constitution of India. 66 BSB, J W.P.No.11369 of 2023 and batch 33. The 2nd respondent – Commissioner & Director of Agricultural Marketing, Government of Andhra Pradesh filed common counter on behalf of the respondents 1 & 2 with the following averments: a. The respondent No.4 / Secretary, A.M.C., Guntur, issued notice vide Rc.No.399/2018-23, dated 05.11.2022, and as per G.O.Ms.No.85, dated 06.11.2020, the petitioners are liable to furnish / fulfil the conditions laid down therein with regard to the bank guarantee, as per their business turnover and has not violated any right of the petitioners under the Constitution of India. The G.O.Ms.No.57, dated 12.10.2015, was challenged by filing several writ petitions and this Court passed interim order suspending the G.O. pending the writ petitions subject to the condition of giving undertaking and later the writ petitions were closed in view of passing G.O.Ms.No.85, dated 06.11.2020, as already noted above. In view of the interim orders, the licenses of the commission agents were renewed with validity up to 31.03.2023. b. The government, with a view to streamline the issue of commission agent licences in regulated market yards categorised the markets into A, B, C depending the volume of trade, and issued revised guidelines for issue of commission agent licences vide G.O.Ms.No.260, dated 28.09.2010. The applicant shall provide a security deposit of the amounts as specified in the said G.O., in addition to collateral security. c. Subsequently, the government re-categorised the markets as A, B, C, D, E & F and modified the amounts of security deposit and collateral security vide G.O.Ms.No.17, dated 31.01.2013. The government modified the G.O.Ms.No.17, dated 31.01.2013, by issuing G.O.Ms.No.57, dated 12.10.2015, duly revising the security deposit and 67 BSB, J W.P.No.11369 of 2023 and batch collateral security as per the turnover of the commission agent (six slabs) for fresh and renewal of commission agent licences. d. To redress the problems of commission agents in payment of security deposit, the Commissioner & Director of Agricultural Marketing submitted a proposal to the Government of A.P., vide letter No.AGC05/11025/2/2019, dated 21.03.2019, to reduce the amount of deposits. The Government of A.P. modified the orders issued in G.O.Ms.No.57, dated 12.10.2015, by issuing G.O.Ms.No.85, dated 06.11.2020, revising and reducing the amount of deposits to a considerable extent for renewal of commission agent licenses. As such, the amounts specified in G.O.Ms.No.85 are now subsisting for renewal of commission agent licences. e. The purpose of security deposit & collateral security is to reduce the sale proceeds payable to the farmer / seller from out of the deposits in case of default of payment of sale proceeds by the commission agents, so as to safeguard the interest of the farming community. The writ petitioners are doing business with turnover in crores of rupees. In view of the above, the writ petitions may be dismissed. 34. The respondents Nos.3 & 4 filed counter affidavit with the averments similar to the counter affidavit of respondents 1 & 2 and further stating that the writ petitions are not maintainable as there are no valid and tenable grounds or cogent reasons in the writ affidavit and that on the other hand, the respondents did not perpetrate to any violation of the fundamental rights contemplated in the Constitution as averred by the petitioner. Hence, these respondents prayed to dismiss the writ petitions. 68 BSB, J W.P.No.11369 of 2023 and batch 35. The petitioner filed reply to the counter affidavit filed by respondents 3 & 4 with the following averments: a. The respondents failed to answer the specific contentions of the writ petitioners regarding unreasonable restrictions being placed by the respondents on the right under Article 19(1)(g) of the Constitution of India. No public interest is involved in imposing the condition of deposit in the impugned G.O. The Supreme Court in Akshay N. Patel Vs. RBI [(2022) 3 SCC 694] propounded several tests for determining ‘reasonableness’, for the purpose of Article 19(6). They ranged from testing restrictions for arbitrariness and discerning their objective of compliance with the directive principles of state policy. The limitation on freedom of trade etc., should not be arbitrary or excessive beyond what is required in the interest of public. Assuming the impugned G.O. stands the test of reasonable restriction, the impugned notice issued demanding bank guarantee is illegal, arbitrary as the G.O.Ms.No.85, denotes that for renewal of commission agent licence for firms having turnover of more than five crores of rupees and dealing with the sale of fruits and vegetables is Rs.2,50,000/-. Therefore, the instant action of the respondents in demanding bank guarantee mentioned in the notice is illegal and arbitrary. b. The rates modified in G.O.Ms.No.85 are still high. The respondents herein have been issuing the said G.Os consistently and creating hurdle for free trade for the various agents including the petitioners herein. The object of the G.O. is to increase competition and eliminate monopoly, but the outcome of the impugned G.O. is contrary to the said object and creating further hurdles to the commission agents from renewing licenses. The respondents failed to make any substantial change to the G.O. and only reduced the amount to be 69 BSB, J W.P.No.11369 of 2023 and batch deposited and still made it on the higher side without maintaining the nexus to the original object of the said G.O. to increase competition and eliminate monopoly. Hence, the writ petitions may be allowed. 36. The respondent No.2 filed additional counter affidavit with the following averments: During the years from 2015-16 to 2023-24, the A.M.C., Guntur / respondent No.4 intimated the petitioners to pay the amount under bank guarantee as per the G.O.Ms.No.85, dated 06.11.2020. A person who applies for a new commission agent licence shall submit notary affidavit stating that he will be doing the business below Rs.1 crore and he will submit the bank guarantee of Rs.50,000/- for fruits and vegetables, Rs.1.00 lakh for other than fruits and vegetables. In case, if he exceeds the declared amount, he shall submit additional bank guarantee. The commission agent licence will be issued to the agent for a period of five (5) years and the bank guarantee will be issued for a period of five (5) years by the concerned custodian bank on behalf of the concerned commission agent to the A.M.C. As and when the commission agent licence period expires, automatically, the bank guarantee will be renewed. Further, no interest will be earned by the A.M.C. on the bank guarantee as it will be with the custodian bank. The Government passed speaking order vide Memo No.AGC01- MKTG0PMIS/79/2023, dated 16.04.2023, on the interim orders passed by this Court as already stated. To safeguard the interest of the farming community, the Commissioner & Director of Agricultural Marketing / respondent No.2 addressed a letter to the Government of A.P. for enhancing the bank guarantee in respect of grant of new commission agent licence consequent to which G.O.Ms.No.21, dated 11.06.2025, was issued. Certain farmers and traders submitted complaint to the 70 BSB, J W.P.No.11369 of 2023 and batch Agricultural Market Committee, Guntur / respondent No.4 against M/s.Vijaya Bhaskara Traders, Managing partner, Sri Gopireddy Srinivasa Reddy and partner, Segali Krishna Reddy, Guntur, for non- payment of sale proceeds. The Selection Grade Secretary, A.M.C., Guntur, issued two notices to M/s. Vijaya Bhaskara Traders. The reply given is not convincing. So, a complaint was lodged against M/s. Vijaya Bhaskara Traders, Managing partner, Sri Gopireddy Srinivasa Reddy and partner, Segali Krishna Reddy, Guntur, in Nallapadu police station, vide F.I.R. / Crime No.898 of 2024, dated 30.11.2024. The Joint Collector and Person-in charge, A.M.C., Guntur, suspended their licence vide order No.286/2024, dated 11.03.2025. To safeguard the interest of the farming community, the Commissioner & Director of Agricultural Marketing addressed a letter to the Government of A.P., for enhancing the bank guarantee in respect of grant of new commission agent licence. The Government of A.P., issued G.O.Ms.No.21, Agriculture and Cooperation (MKTG.II) Department, dated 11.06.2025, revising the amount of bank guarantee, stating – “Commission agents applying for fresh licenses shall declare their estimated annual turnover and submit a Bank Guarantee accordingly. If during the course of the year, the actual turnover exceeds the declared amount, they shall submit an additional Bank Guarantee immediately upon receipt of the notice from the Agricultural Market Committee, failing which their licences shall be liable to be cancelled.” It is prayed to dismiss the writ petition. 37. The learned counsel for the petitioners submitted that there is no authority given to the state government to amend the fee for renewal of the existing licence as per Rule 49 of the Rules, 1969, and that the power given to the government is only to amend the amount of fee for 71 BSB, J W.P.No.11369 of 2023 and batch ‘grant’ of fresh licence, i.e., in other words, that there is no similar authority given to the government to amend the fee for ‘renewal’ of the licence already granted. In fact, there is no such ground taken in the writ petitions. 38. However, the learned government pleader and the standing counsel for A.M.C., representing the respondents, contended that by virtue of the amendment introducing Section 7 (1-B) of the Act, 1966 with effect from 09.10.2015 (by Act No.14 of 2015) and the Rules, 1969, vide G.O.Ms. No. 38, dated:10.05.2016, amending Rule 49, read with Section 33 (1) and (2) (viii) and (x) of the Act, 1966, the government is enabled to alter the amount of fee not only for ‘grant’ of a fresh / new licence, but also for ‘renewal’ of an existing licence granted before the amendment and therefore, there is no force in the argument of the petitioners that the government has no authority to enhance the amount of fee for renewal of the licence. The Agricultural Market Committee may reject the application duly mentioning the reasons for such rejection. (5) No person shall operate as a commission agent in the notified market area unless he has furnished and continues to maintain a security, commensurate with his turnover, by way of bank guarantee as well as deposited the amounts specified by the Government from time to time. (6) … (7) Every licence granted under this rule shall be valid for a period of 5 (five) years from the date of issue. By virtue of Section 7(1) of the Act, 1966, no person shall trade or act as a commission agent within the notified area without a licence granted to him by the Market Committee. As per Section 7(3) of the Act, 1966, a licence granted under Section 7(1) shall be in such form and subject to payment of such fees as may be prescribed. Thus, charging of fee for grant of licence is permitted by virtue of Section 7(3). Section 7(5) of the Act, 1966 mandates that a person to whom a licence is granted under Section 7(1) shall comply with the provisions of the Act, 1966, the Rules and the bye-laws made thereunder and the conditions specified in the licence. Further, the authority of the Government to regulate or prohibit commission agents operating in the market emanates from 74 BSB, J W.P.No.11369 of 2023 and batch Section 32 of the Act, 1966 and the authority of Government to make rules emanates from Section 33 of the Act, 1966. 39. Pursuant to such authority, the Rules, 1969 were framed by the State Government. For the purpose of the present case, Rule 49 as was before and is after the amendment in the year 2016 are relevant. 40. A reading of the above provisions, particularly Section 7 of the Act, 1966 and Rule 49 of the Rules, 1969 clearly indicates that by virtue of the amendments, licence for commission agents was introduced and the government is enabled to charge / modify the fee not only for issuance of a new licence but also for renewal of an existing licence after the amendments came into force. Therefore, the contention that the government has no authority to enhance the fee for renewal of licence is not sustainable. 41. The learned counsel for the petitioners submitted that the amount enhanced is disproportionately high. He further submitted that the amount of fee fixed is to be paid irrespective of the amount of annual turnover of a trader as he is required to pay a minimum of Rs. 50,000/- for the category of fruits and vegetables and commission agent belonging to S.C. / S.T. and a minimum of Rs. 1,00,000/- for category other than fruits and vegetables, though the turnover is equal to or less than the amount of fee. Therefore, he submitted that imposition of such fee is illegal, arbitrary and violative of fundamental right to freedom of trade and right to livelihood. 42. In reply, the learned Government Pleader and the standing counsel for A.M.C. submitted that it is not an obligation to pay the amount and it is only that a bank guarantee shall be furnished, and therefore, there is no financial burden on the trader or agent and that no 75 BSB, J W.P.No.11369 of 2023 and batch single petitioner in the batch of writ petitions has a turnover less than the amount of fee but on the other hand, all of them have high amount of turnover per annum in crores of rupees. They further submitted that the amount of fee would be apportioned only for the benefit of managing the A.M.Cs. and is necessary in the event of any fraud being played by the agents and in fact, the amount so paid as fee is much more inadequate than the amount of damage likely to be caused to the farmers in case of fraud committed in the business. 43. In reply, the learned counsel for the petitioners submitted that there is no such objective indicated in the impugned G.O. However, he submitted that the petitioners are prepared to negotiate with the concerned officials of the government to revise the amount of bank guarantee in the interest of the farmers and the traders / agents. 44. During the course of hearing of these writ petitions, G.O.Ms.No.85, dated 06.11.2020, is superseded by G.O.Ms.No.21, Agriculture and Cooperation (MKTG.II) Department, dated 11.06.2025. As per G.O Ms No 85, dated 06.11.2020 Turnover (Rs. In crores) Fruits and Vegetables Other than Fruits and Vegetables Commission agents belonging to SC / ST Renewal of commission agents licence Above 5 2.5 Lakhs 5 lakhs 50,000/- Between 1 to 5 1 lakh 2 lakhs Below 1 50,000/- 1 lakh As per G.O Ms No 21, dated 11.06.2025 Turnover (Rs. In crores) All notified agricultural commodities Commission agents belonging to SC / ST For fresh new commission agent licences Above 5 7 Lakhs 1 lakh Between 1 to 5 4 lakh Below 1 2 lakhs 76 BSB, J W.P.No.11369 of 2023 and batch As per G.O.Ms.No.21, the Director of Agricultural Marketing, A.P., Guntur is directed to collect the security deposits in respect of old commission agent licences in accordance with the orders issued in G.O.Ms.No.85, dated 06.11.2020, and for fresh new commission agent licences as mentioned in G.O.Ms.No.21, dated 11.06.2025. 45. As the subsequent G.O.Ms.No.21 has prospective effect of implementation, the question whether the G.O.Ms.No.85 is legal or not still remains to be answered in view of the undertaking given for renewal of the licence during the period of its validity after filing of the writ petitions. 46. A perusal of the changes brought about in the amount of security deposit and collateral security for issuance of licence discussed above indicates that by omitting two kinds of obligations to provide security deposit in the form of N.S.C bonds / cash and collateral security, single form of bank guarantee was introduced by G.O.Ms.No.85, dated 06.11.2020. Except the fact that a fixed amount of bank guarantee was provided irrespective of the amount of turnover below the amount of bank guarantee to be furnished, there is no other ground to contend that the amount of bank guarantee provided is financial hardship leading to restriction on the trade. Even though it was stated that none of the petitioners is dealing with small amount of turnover to face the hardship pointed out in the arguments, no petitioner stated that they, in general, or personally suffered hardship due to the amount of bank guarantee fixed in the said G.O. to person having turnover below Rs.1 Crore. Unlike cash deposit or N.S.C. bond, a bank guarantee does not impose financial burden. Therefore, there is no substance in the challenge made to the G.O.Ms.No.85, dated 06.11.2020, on any ground. 77 BSB, J W.P.No.11369 of 2023 and batch 47. As such, the notices impugned in the writ petitions are not required to be interfered with. 48. In the result, the writ petitions are dismissed. There shall be no order as to costs. Pending miscellaneous petitions, if any, shall stand closed. __________________ B.S. BHANUMATHI, J Dt.09.03.2026 RAR
