1. The petitioner has filed the present petition seeking the following reliefs:–
“10.1 That this Hon'ble Court be pleased to call for the entire records from the respondents for its kind perusal. 10.2 That this Hon'ble Court be pleased to issue a writ in the nature of certiorari quashing the impugned orders Annexure P-1 and Annexure P-2 and further consequential relief(s) may also be granted. 10.3 That this Hon'ble Court be pleased to direct the respondents to revoke the suspension of petitioner with immediate effect and grant the full salary of suspension period along with arrears of salary with 10% interest p.a. and also compensate the petitioner for the harassment and agony suffered. 10.4 That this Hon'ble Court be pleased to direct the respondents to pay the cost of litigation. 10.5 That any other order or orders, direction or directions, writ or writs, as this Hon'ble Court may deem fit under the facts and circumstances of the case may also be issued in favour of the petitioner against the respondents.”
2. Mr. Agrawal, learned counsel appearing for the petitioner would submit that the petitioner was placed under suspension on 04.03.2020 and his suspension order has been revoked vide order dated 29.08.2022/
01.09.2022. He would contend that the respondents have not made payment of subsistence allowance to the petitioner. He would contend that subsistence allowance is not a bounty, rather it is a right of the petitioner. He prays that the petitioner may be permitted to make a representation before the respondent authorities claiming subsistence allowance.
3. On the other hand, Mr. Amandeep Singh, learned Panel Lawyer appearing for the State would submit that as the suspension order of
3 the petitioner has already been revoked, the present petition has become infructuous.
4. Taking into consideration the limited prayer made by Mr. Agrawal, this petition is, at this juncture, disposed of reserving liberty in favour of the petitioner to make a representation before the authorities concerned , claiming subsistence allowance and arrears of payment, and in turn, the respondent No.3 is directed to decide the said representation within a period of 90 days.
5. With the aforesaid observation(s) and direction(s), the petition stands
