Order 08/04/2026
1. Apprehending his arrest in connection with FIR No.2023- 24/53 registered at Police Station-Kishangarh, District-Ajmer for the offences under Sections 54(A), 16/54 and 19/54 of Rajasthan Excise Act, 1950, the petitioner has preferred this bail application under Section 482 BNSS.
2. Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on record.
3.
Learned counsel for the petitioner submits that the petitioner is the owner of the truck in respect of which allegations have been made regarding the transportation of illegal spirit. It is submitted that a mere perusal of the record would reveal that the petitioner has been falsely implicated in the present case on concocted grounds, and there is no material to establish that the vehicle of the petitioner was engaged in illegal transportation of spirit. The
[2026:RJ-JP:14577] (2 of 3) [CRLMB-9367/2025] petitioner had obtained all requisite documents necessary for the transportation of spirit, including the valid permit, tax invoice, delivery/challan letter, panchnama, as well as the affidavit of the driver which shows that the transportation of spirit was being carried out under valid authorization and in compliance with the applicable provisions. It is further contended that allegations are baseless and no custodial interrogation is required. Petitioner is ready to cooperate with investigation. Hence, the anticipatory bail application of the petitioner may be allowed.
4. Learned Public Prosecutor has vehemently opposed the bail application and submitted that in the vehicle which belongs to the petitioner illegal spirit was being carried therein, therefore, the petitioner is not liable to anticipatory bail though the prosecution is unable to refute the submissions and documents placed on record by the learned counsel for the petitioner.
5. Considering the nature of allegations and arguments advanced by learned counsel for the petitioner but without commenting on the merits/demerits thereof, this Court deems it just and proper to allow the bail application of the petitioner.
6. Accordingly, the bail application under Section 482 BNSS is allowed and it is ordered that in the event of arrest of the petitioner-Shailesh Kumar Raj Saroha S/o Rajpal Singh, he shall be released on bail on his furnishing a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station on the following conditions:- (i) that the petitioner shall make himself available for interrogation by a police officer as and when required;
[2026:RJ-JP:14577] (3 of 3) [CRLMB-9367/2025] (ii) that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the
facts of the case so as to dissuade him from disclosing such facts to the court or any police officer, and (iii) that the petitioner shall not leave India without prior permission of the court.
