By these both applications, the applicant is seeking the condonation of 1067 days in filing the restoration application and restoration of First Appeal St. No.2005/2022. 2. It is pointed out by the appellant that for deficit court fees, the registration of the appeal was refused by the Registrar of this court. It is stated that the appellant has forwarded the deficit court fee amount through cheque. The amount of cheque was given in the name of the District Court and same was inadvertently accepted by the High Court. However, as it was a mistake on the part of the Registry, some time was consumed for returning back of the amount and to file fresh cheque in the present appeal. 3. As such, considering the reasons stated in the present application, the delay is condoned. The order passed by this court of refusing the registration of appeal is recalled. The office is directed to restore First Appeal St. No.2005/2022 in the
2 73 CAO 404.26.odt matter, subject to condition that the appellant shall deposit the deficit court fee within a period of three weeks. 4. Both the applications stand disposed of.
