The petitioners are apprehending their arrest in connection with Rajmahal P.S. Case No.146 of 2026, for the offence registered under Sections 126(2), 115(2), 117(2), 109(1), 303(2) and 3(5) of Bharatiya Nyaya Sanhita, 2023, pending in the court of learned S.D.J.M., Rajmahal. 3. At the outset, learned counsel appearing for the petitioners submits that so far petitioner No.5 namely Subodh Kumar Sharma @ Subodh Sharma is concerned he has already been apprehended and in that view of the matter, he is not pressing the anticipatory bail application in respect of petitioner No.5, namely, Subodh Kumar Sharma @ Subodh Sharma. 4. In view of his such submission, the prayer of petitioner No.5, namely Subodh Kumar Sharma @ Subodh Sharma, is rejected as not pressed. 5. Learned counsel appearing for the petitioners submits that there are case and counter case and the altercation took place due to land dispute and both the sides are agnates. He further submits that for the land dispute one partition suit is going on being Original Partition Suit No.148 of 2025 pending in the Court of learned Senior Civil Judge-I, Sahibganj. He then submits that entire family members have been made accused and even the lady members of the family have been made accused. On these grounds, he submits that anticipatory bail may kindly be granted. 6. Learned counsel appearing for the State and Informant jointly opposed the prayer and submits that allegations are there of assault and 2026:JHHC:20955 --3-- A.B.A. No. 3792 of 2026 in view of that anticipatory bail may kindly be rejected. 7. Considering that there are case and counter case and both the sides are agnates and original partition suit is also going on between the parties and the radiology report has not been received as yet, as noted in the order of learned Sessions Judge. In the attending facts and circumstances of this case, I am inclined to provide privilege of anticipatory bail to the petitioner Nos.1 to 4, namely, Subhash Kumar Sharma @ Subhash Sharma, Meera Devi, Ritu Kumari @ Ritu Devi and Kanchan Kumar @ Kanchana Devi respectively. 8. Accordingly, petitioner Nos.1 to 4, above named, are hereby directed to surrender before the learned Court within three weeks from today, and in the event of their surrender/arrest, petitioner Nos.1 to 4, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of the like amount each, to the satisfaction of learned S.D.J.M., Rajmahal in connection with Rajmahal P.S.
