Heard Mr. H R A Choudury, learned senior counsel for the petitioners. Also heard Mr. Bhaskar Sharma, learned Additional Public Prosecutor, Assam. Both these bail applications are filed under Sections 482 and 483 of the BNSS, 2023 whereby the petitioners Baharul Haque Laskar has prayed for pre-arrest bail in respect of Dispur P.S. Case No. 60/2026 and Smti. Amrin Aktar Laskar has prayed for releasing her on bail after she was arrested in the aforesaid case. The informant is a member of Bachpan Bachao Andolon. The District Labour Task Force along with an Executive Magistrate and Police force went to rescue a minor girl from the house of the petitioners. There was a complaint that the petitioners used to physically harass the minor girl in their house. The said tram discovered that the minor girl was kept confined below the box of the bed. There was lot of scars on her body. The minor girl was produced before the Judicial Magistrate for recording her statement under Section 183 of the BNSS, 2023. She stated before the Magistrate that she was 13 years old and at the age of 7, her mother brought her to the house of the petitioners. The minor girl was used as a maid doing household works. She was beaten up by the petitioner Amrin very frequently. On one occasion, Amrin had hit her head with the lid of pressure cooker. She sustained serious injuries for all those harassments.
During winter, she was not allowed to use blankets and was compelled to sleep on the floor. During summer, she was not allowed to use the fan. She further stated that when the Police team came to the house of the Amrin she put her inside the box of the bed. I have considered the submissions made by the learned counsel of both sides. The petitioner Amrin Aktar Laskar does not deserve to be released on bail for the allegations brought
Page No.# 3/3 against her. Mr. Choudhury has submitted that the petitioner Baharul Haque Laskar works at Majuli and he has no knowledge about the conduct of his wife. This Court is of the opinion that the plea taken by Mr. Choudhury in respect of Baharul Haque Laskar is not acceptable under the given circumstances. Therefore, the prayer of Amrin Aktar Laskar as well as the prayer made by Baharul Haque Laskar are rejected. Both the bail applications are disposed of. Case diary shall be returned.
