Kuldeep, Advocate For Respondents : Mr. Vinod Deshmukh, Advocate Hon’ble Shri Justice Rakesh Mohan Pandey Judgment On Board 13.5.2026 1) Learned counsel for the petitioner submits that petitioner’s mother namely Namita Shende who was working on the post of Cleaner- cum-Sepoy under respondent bank died in harness on Digitally signed by AJINKYA PANSARE Date: 2026.05.13 17:54:35 +0530 2 21.11.2012. He further submits that petitioner applied for grant of compassionate appointment on 20.2.2017 but till date no decision has been taken by the bank authorities. 2) On the other hand, learned counsel for the respondents submits that application moved by petitioner for grant of ex-gratia amount in lieu of appointment on compassionate grounds has already been rejected by the Assistant General Manager (HRM) vide letter dated 24.4.2015 (Annexure R/3) on the ground that monthly income of family from monthly pension is more than 60% of the last drawn gross salary of Lt. Namita Shende. He further submits that on being unsuccessful in his attempt to receive ex-gratia amount in lieu of appointment on compassionate grounds, petitioner is trying to seek compassionate appointment. He contends that this petition deserves to be dismissed. 3) Heard. 4) It appears that claim of petitioner for grant of ex-gratia amount in lieu of appointment on compassionate grounds has already been rejected by the respondent Bank vide order dated 24.4.2015 whereas in this petition, petitioner is claiming compassionate appointment. Be that as it may, the aforestated order has been placed on record along with the return filed by respondent-Bank on 31.8.2018 and petitioner has not challenged it before any higher forum. 3 5) Taking into consideration the above-stated facts, in my opinion, no relief can be granted to the petitioner.
