Sinha, Advocate For the Resp.-State : Mr. Ankit Kumar, A.C to S.C.-I 08/10.02.2026 The present writ petition has been filed for the following relief(s): “For issuance the of an appropriate Writ, Rule, Order, Direction for quashing the order dated 26.06.2015 passed by the Circle Officer, Patratu in Mutation Case No. 63 of 2015-16 by which the Respondent No.4 has illegally rejected the application filed by the petitioner for mutation of his name in the Revenue Records with respect to the lands measuring 1.03 ½ Acre appertaining to Plot No. 304 of Khata No.118 situated at Mouza Bujurg Jamira, P.S. Patratu, District Ramgarh contained in Annexure-1 to the writ petition and for quashing the order dated 30.08.2022 passed by the Land Reforms Deputy Collector, Ramgarh in Mutation Appeal Case No. 09 of 2015-16 (Annexure-2) dismissing the appeal filed by the petitioner and for quashing the order dated 23.05.2023 passed by the Deputy Commissioner, Ramgarh in Mutation Revision Case No. 14 of 2023 (Annexure-3) dismissing the Revision filed by the petitioner on 2026:JHHC:3507 2 W.P.(C) No. 6137 of 2023 absolutely irrelevant consideration of the materials on the record and for such other relief or reliefs to which the petitioner is legally entitled to.” 2. The description of the land is as follows: Lands measuring 1.03 ½ Acre appertaining to Plot No. 304 of Khata No.118 situated at Mouza Bujurg Jamira, P.S. Patratu, P.S.No. 81District Ramgarh 3. Petitioner is claiming mutation on the basis of sale deed dated 29.09.2014. 4. Admittedly, the land in question is a joint family property, portion of which cannot be sold by a co-sharer without taking consent of the other co-sharers. 5. It further appears that a partition suit is pending amongst the family members being Partition Suit No. 249 of 2013 wherein the purchaser has also been made party. 6. In that view of the matter, this Court finds that competent authorities have rightly passed the impugned orders observing that mutation will depend upon the out come of the civil suit pending between the parties. I find no ground to interfere with the impugned orders. 7. Accordingly, the present writ petition is disposed of with a liberty to the petitioner to work out his remedy in accordance with law.
