12. In so far as compensation is concerned, the stand of the LAC as per affidavit dated 7th February, 2026 is that pursuant to the order dated 11th December, 2018 in W.P.(C) No. 3563/2016, the LAC had passed order dated 19th August, 2019, wherein it was observed that the possession of the subject land had not been taken over, and as per the LAC, the recorded owner of the subject land was Manohar Lal. 13. Furthermore, it is also contended that the Petitioner claims to have purchased the subject land from Shri Ram Kishore, through an Agreement to Sell and General Power of Attorney. However, the Petitioner has not been able to prove the title of Shri Ram Kishore on the subject land. The relevant portion of the additional affidavit filed by the LAC, dated 7th February, 2026
W.P.(C) 2493/2023 Page 9 of 10
is as under:
“[...]9. That it is submitted that petitioner is claiming to have purchased the land from Shri Ram Kishore S/o Shri Nek Ram Dwivedi through Agreement to sale, General Power of Attorney and will dated 04.03.2008 i.e. after issuance of notification under section 4 and 6. Even the person from whom the petitioner claims to have purchased the land is not the recorded owner. xxx xxx xxx
14.
That it is submitted that as per record/Naksha Muntzamin, the ownership of the land comprised in khasra No. 2//1411 (2-11) is mentioned at serial No. 23 to 37 of the Naksha Muntzamin. Initially compensation amount was assessed in the name of persons mentioned at serial Nos. 23 to 37 of the Naksha Muntzamin. Later on corrigendums were issued nd compensation amount for this khasra No. 2// 1411(2-11) was deducted from original compensation being disputed land. As per record compensation amount for the land in question has not been paid to any one…”
14. In view of the fact that the ownership of the subject land has not been proved to be related to the predecessor of the Petitioner from whom the Petitioner is stated to have purchased the land, the contention of the LAC is that no compensation was paid. 15. Therefore, as of today, no compensation has been paid to any person. 16. In this background, the short issue as to whether the Petitioner is entitled to any compensation stands addressed, as the NHAI is stated to have already deposited the compensation with the LAC. 17. It is now for the LAC and thereafter the concerned Additional District Judge to consider the reference petition, if required, under Sections 30 and 31
W.P.(C) 2493/2023 Page 10 of 10
of the Land Acquisition Act, 1894 (hereinafter, ‘Act, 1894’) and examine the validity of the documents relied upon by the Petitioner and process the compensation in accordance with law. 18. Accordingly, the Petitioner is permitted to file a claim petition seeking compensation. 19. After examining the documents, the LAC may release the compensation. Thereafter, if the need arises, the LAC to make a reference under Section 30 and 31 of the Act, 1894 and the same be adjudicated within a period of six months. 20. The present petition is disposed of in these terms. Pending applications, if any, are also disposed of. PRATHIBA M. SINGH JUDGE
