[2026:RJ-JP:1673] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 16303/2025 1. Lali Devi W/o Late Nanda, Aged About 45 Years, 2. Bhanwar Lal S/o Late Nanda, Aged About 25 Years, Both are R/o Bagriya Ki Dhani, Bhagera. Currently Residing Behind Government ITI, Near New Tehsil Kekri, Police Station Kekri, District Ajmer, Rajasthan. (At Present, the Petitioners are in District Jail, Ajmer). ----Petitioners Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Ms. Sonali Kharra, Adv. for Mr. Rajaram Chaudhary, Adv. For Respondent(s) : Mr. Manvendra Singh, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 15/01/2026 1. The instant bail application has been filed under Section 483 of B.N.S.S. on behalf of accused-petitioners. The accused- petitioners have been arrested in connection with FIR No.339/2022, registered at Police Station Kekri City, District Ajmer, for the offence(s) under Sections 420, 467, 468 and 120-B of IPC. 2. Learned counsel for the petitioners submits that the accused- petitioners have falsely been implicated in the present case. It is contended that petitioner No.1 is a woman and petitioner No.2 is suffering from permanent locomotor disability and is unable to move on his own. It is further submitted that the co-accused Ramraj against whom main allegation of fabricating the sale deed [2026:RJ-JP:1673] (2 of 3) [CRLMB-16303/2025] has been levelled, has already been enlarged on bail by the Co- ordinate Bench vide order dated 09.11.2022. It is contended that the only allegation against the present petitioners is that they acted as witnesses to the alleged sale deed. It is argued that the accused-petitioners are in custody since 22.11.2025, the matter is exclusively triable by Magistrate and the trial of the case may take considerable time, therefore, the bail application of the accused- petitioners may be allowed. 3. Learned Public Prosecutor has vehemently opposed the grant of bail application and contended that the accused-petitioners along with other co-accused fabricated the documents and deceived the complainant, therefore, the bail application of the accused-petitioners may be dismissed. 4. Heard and perused the material available on the record. 5. Considering the fact that the co-accused Ramraj against whom the allegation of forging the documents are levelled, has already been enlarged on bail by the Co-ordinate Bench vide order dated 09.11.2025 and the matter is exclusively triable by Magistrate, therefore, without expressing anything on the merits of the case, this Court deems it just and proper to enlarge the accused-petitioners on bail. 6. Accordingly, the bail application under Section 483 of B.N.S.S. is allowed and it is ordered that the accused-petitioners namely; 1. Lali Devi W/o Late Nanda and 2. Bhanwar Lal S/o Late Nanda, in connection with FIR No.339/2022, registered at Police Station Kekri City, District Ajmer, shall be enlarged on bail provided both of them furnish a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the [2026:RJ-JP:1673] (3 of 3) [CRLMB-16303/2025] satisfaction of the learned trial Judge for their appearance before the Court concerned on all the dates of hearing and as and when called upon to do so.
