JUSTICE H.P.SANDESH ORAL ORDER This Court vide order dated 18.04.2023 suspended the sentence, subject to depositing 50% of the fine amount inclusive of amount already deposited, if any, before the Trial Court within a period of four weeks. On 21.03.2024, the learned counsel for the respondent made the submission that the conditional order has not been complied and hence, this Court granted liberty in favour of the respondent/complainant to proceed against the petitioner. On 04.04.2024, the learned counsel for the petitioner submitted that payment has been made and hence, this Court directed the respondent’s counsel to keep the complainant present before the Court on 19.04.2024. On 19.04.2024, the respondent/complainant made the submission that amount is not paid and hence, this Court directed the Registry to send the records to the Trial Court to proceed against the petitioner. - 3 - HC-KAR NC: 2026:KHC:28143 CRL.RP No. 488 of 2023 2.
